Annex 3 – Conditions attached after a hearing by the licensing authority
A number to be provided for residents by placing a notice in the window. ¿ Conditions 1 – 4 as suggested by the Environmental Health Officer: 1. The Licensee shall ensure, by checking at least weekly, that all signs are in position and well maintained. 2. Prior to closing time, announcements shall be made by the DJ or other staff informing patrons that it is a residential area and to disperse quickly and quietly. 3. No external loudspeaker systems shall be installed without the prior approval in writing of the Environmental and Health Department. Previous condition 3 was removed at a subsequent hearing therefore condition 4 is condition 3. Prevention of Public Nuisance added after hearing: 1st July 2009. All conditions (1 to 6) as suggested by The Environmental Health Officer: 1.Suitable and conspicuous notice shall be displayed in the outside areas and at all entrance & exits; requesting patrons to male the minimum noise when using the outside areas & when leaving the premises. The Licensee shall ensure, by checking at least weekly, that all signs are in position and well maintained. 2. Ensure the timber external door leading to the beer garden is kept in order to prevent noise pollution to residential properties nearby, except in the case of emergency. 3. Ensure that the doors and windows of the pub are kept closed (except for ingress & egress) when live, amplified or recorded music is being played within the premises, in order to prevent noise pollution to residential properties nearby, except in the case of emergency. 4. Ensure that live music is only performed in the rear left function room (looking from the front of the premises), as far away from the timber door to the beer garden as possible. 5. Ensure that when live or amplified music is being performed within the premises that temporary acoustic boarding is out in place: on the timber door to the beer garden, on the sash window facing the beer garden and on the window to the left flank of the rear function
The prevention of public nuisance
1. To implement and comply with the terms of a Dispersal Policy. The Dispersal Policy is to include:
• Requirement for the volume of the music (recorded or live) to be reduced in the last 30 minutes of any event or occasion when music is played i.e. the last 30 minutes of music is played at a reduced volume.
• Requirement for the lighting to be gradually increased in the last 30 minutes before the event ends.
• Requirement for staff to take active steps to re-inforce the signage about leaving quietly in a residential area and record that this has been done in a maintained register available for inspection.
• Requirement for staff to make a specific announcement asking customers to leave quietly as part of the active enforcement of the signage.
• Requirement for all customers waiting for taxis/vehicular collection to be asked, and allowed to, remain in the premises to wait for collection up to the licensed closing time of the premises.
The Dispersal Policy is to be agreed with the Licensing Authority and the Environmental Health Authority and implemented within 28 days of the decision.
