2. The employer must appoint an external agency, for a period of 12 months, to carry out checks relating to the right to work of their employees at the premises and any prospective employees before entering into a contract of employment.
3. Any copies of documents retained by the employer as a result of conducting checks relating to the right to work must be stored securely by the employer at the premises or a digital copy be immediately accessible from the premises for ease of inspection by immigration officials, the Licensing Authority and the Police. Where documents are also held by an external agency then the name of that agency shall be made available to Immigration Enforcement officials, the Licensing Authority and the Police on request.
4. the employer, or any person appearing to represent the employer, must be able to produce on demand documents relating to the right to work, at the request of an immigration officer, a licensing officer or a Police officer who enters the premises to carry out an inspection under section 179 (1A) of the 2003 Act.
