Licensing Act 1964, Sections 95 - Part IV licences for restaurants, guest houses etc
Alcohol may be sold or supplied: a. On weekdays, other than Christmas Day, Good Friday or New Year’s Eve from 11a.m. to 12p.m. On Sundays, other than Christmas Day or New Year’s Eve and on Good Friday, 12 noon to 11.30 p.m. On Christmas Day 12 noon to11.30 p.m. On New Year’s Eve, except on a Sunday, 11 a.m. to midnight. On New Year’s Eve on a Sunday, 12 noon to 11.30 p.m. On New Year’s Eve from the end of permitted hours on New Year’s Eve to the start of permitted hours on the following day (or, if there are no permitted hours on the following day, midnight on 31 December).
The above restrictions do not prohibit: During the first twenty minutes after the above hours the consumption of the alcohol on the premises; During the first twenty minutes after the above hours, the taking of the alcohol from the premises unless the alcohol is supplied or taken in an open vessel; During the first thirty minutes after the above hours the consumption of the alcohol on the premises by persons taking meals there if the alcohol was supplied for consumption as an ancillary to the meals; Consumption of the alcohol on the premises or the taking of sale or supply of alcohol to any person residing in the premises.
Suitable non-alcoholic beverages, including drinking water shall be equally available for consumption with or otherwise as an ancillary to meals served in the licensed premises.
The premises must be bona fide used for the purpose of habitually providing for reward board and lodging including breakfast and one other at least of the customary main meals.
Alcohol shall not be sold or supplied on the premises otherwise than to persons residing there or their private friends bona fide entertained by them at their own expense, and for consumption by such a person or his private friend so entertained by him either on the premises or with a meal supplied at but to be consumed off the premises. General Conditions The Licensee will provide written and published conditions of entry to which all persons entering the premises will be required to comply with. Crime and Disorder The Licensee shall restrict access to residents, bone fide guest and staff between 23.00 hours and 06.00 hours. Public Safety The Licensee will implement sound and consistent management of the premises maintaining its safe and orderly environment, and will ensure that all staff are appropriately trained to support this. The performance of live music outdoors shall finish no later than 22:00 on any night of the week during the permitted season, except for the end of season party night and on no more than 5 other nights throughout the season, at which times the performance of live music outdoors shall finish no later than 24:00 hours.
The playing of recorded music outdoors shall finish no later than 23:00 on any night of the week during the permitted season, except for the end of season party night and on no more than 5 other nights throughout the season, at which times the playing of recorded music outdoors shall finish no later than 24:00 hours.
The volume of any amplification system used in connection with the performance of live music and the playing of recorded music at the premises, both indoors and outdoors, shall be strictly controlled so that noise levels are non-intrusive at the boundaries of nearby residential properties. Protection of children from harm The Licensee will ensure that any child entering the premises are under the direct supervision of parents/guardians who will be made aware of their responsibilities for the conduct and safety of any child in their custody.
