Annex 1 - Mandatory conditions
Conditions carried over from Licensing Act 1964
Conditions carried over from Local Government (Miscellaneous Provisions) Act 1982 (Public Entertainment Licence):
This Licence is subject to the provisions of the said Act, to the Regulations and Conditions now or from time to time made by the local Council and to any Additional Conditions included on this Licence.Additional Conditions:1) The electrical installation shall be inspected at least once in every five years, or such lesser period as is considered appropriate to the individual case, by a competent electrical engineer appointed by or on behalf of the licensee of the premise and a certificate stating the condition of the installation shall after each inspection, be forwarded to the Council by or on behalf of the licensee of the premise.2) The number of persons (excluding staff and attendants) to be allowed at any one time in the licensed premise shall not exceed: 300)
3)An electronic limiting device shall be fitted and set at such a level as to render any music inaudible outside the curtilage of the premises.4) A part of the premises shall be designated as a dance area for public use.5) The licence holder or anyone involved in the organisation of entertainments (including those controlling the volume of music) shall ensure that any noise emanating from the premises is such as not to cause annoyance or disturbance to residents in the locality.6) All doors and windows on the façade(s) of the building, which are the subject of this consent, shall be kept closed at all times during the entertainment events, except when access is required to/from the premises.
Licensing Act 2003, Section 19: Mandatory conditions where licence authorises supply of alcohol(1) Where a premises licence authorises the supply of alcohol, the licence must include the following conditions. (2) The first condition is that no supply of alcohol may be made under the premises licence:(a) at a time when there is no designated premises supervisor in respect of the premises licence, or(b) at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.(3) The second condition is that every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
Annex 2 - Conditions consistent with the operating schedule
General:
No new steps have been identified by risk assessment in relation to the four licensing objectives, except as below, we will continue with McMullens current successful operational standards and training of our teams. Only such conditions and restrictions as are inherent in the licensing act 1964

The Prevention of crime and disorder:
Providing a 30 minute extension of opening hours after the end of the sale of alcohol will promote this objective, as the last drink will consumed less quickly, with access to the pub's toilet facilities.
Disruptive customers, known drugs users/dealers entering the premises will be refused service and will be asked to leave. There will the be no serving of drunks.
The pub will be a member of a local pubwatch scheme. There will be appropriate liaison with local licensing officer.
There will be no new patrons admitted to the premises after 23.00 hours on the occasions when public entertainment is provided subject to this licence.
Public Safety:
The premises will adhere to current health and safety and fire safety regulations.
The DPS will ensure fire escapes are not locked.
Fire extinguishers to be maintained annually. There is a fire blanket located in the kitchen and a fully maintained first aid kit on site the number of persons (excluding staff and attendants) to be allowed at any one time in the licensed premises shall not exceed 300.
The electrcial installation shall be inspected at least every 5 years, or such lesser peiod as considered appropriate to the individual case, by a competent electrical engineer appointed by the premises licence holder and a certificate stating the condition of the installation shall be held at the premises licence holder head office a copy of which will be forwarded to upon request to the licensing authority within 24 hours of that request.

The prevention of public nuisance:
The Manager and staff will encourage customers to leave quietly. The 30 minute "wind down" period will encourage a gradual dispersion of customers to minimise noise.
In respect of musical entertainment an electronic limiting device shall be fitted and set to such a level as to render any music inaudible outside and curtilage of the premises.
The D.P.S or anyone involved in the organisation of entertainments (including those controlling the volume of music) shall ensure that any noise emanating from the premises is such as not to cause annoyance or disturbance to residents in the locality.
The D.P.S will ensure during musical entertainment all doors and windows are closed except for the ingress and egress of customers.
Notice shall be displayed at exits to the premises reminding patrons to leave quietly.
Customers will not be permitted to take open containers beyond the curtilage of the premises licence holders property.
The protection of children from harm:
With the exception of the AWP'S and a cigarette machine there shall be no adult entertainment services, activities or matters ancillary to the use of the premises that may give rise to concern in respect of children.
Children less than 18 years old will not be allowed into the premises after 2200 hours. Unaccompanied children before 2200 hours will be asked to leave the premises. Any persons suspected of being under 18 years old will be asked for identification in the form of a current driving licence or passport. Failure to provide adequate proof of age will result in the person being ordered to leave the premises.
All AWP's and cigarette machines will be sited in view of the bar so that their usage can be monitored and controlled. Signs on the machines will indicate that children under the age of 18 are forbidden from using them. The premises will not show videos or TV transmissions that are unsuitable for children under 18 years of age before 2300 hours.
Notices will be displayed indicating that the premises operates a proof of identity scheme and that if a person appears to be under 21 they may be asked for proof of identity.
