Licence conditions (17)

The Licence Holder or his representative shall conduct regular assessments of the noise coming from the premises on every occasion the premises are used for regulated entertainment and shall take steps to reduce the level of noise where it is likely to cause a disturbance to local residents. A written record shall be made of said assessments in a log book kept for that purpose and shall include the time and date of the checks, the person making them and the results, including any remedial action.
There shall be adequate supervision and control of patrons in external areas within the curtilage of the premises to prevent any disturbance to residents in the vicinity.
Any external areas within the curtilage of the premises must be kept free from waste, including discarded smoking materials, unless in suitable receptacles which are appropriately and regularly emptied.
All external doors and windows shall be kept closed when regulated entertainment is being provided except in the event of an emergency or for the purposes of access and egress.
No light from or on the premises and any other light under the control of the premises shall cause nuisance to any other premises.
No refuse shall be disposed of from the premises into a receptacle where such disposal is likely to cause a disturbance to residents in the area of the premises at any time between 20:00 and 08:00 on any day except Sunday when no such disposal shall take place before 10:00.
There shall be no emission from the premises of any odour which is likely to cause a nuisance to nearby premises.
All fixed plant and equipment at the premises that produce significant levels of noise shall be fitted with appropriate means of noise suppression and be restricted in their use so as to minimise disturbance to any neighbouring noise sensitive premises.
All amplified regulated entertainment shall be provided by way of a system under the control of the Management and shall be controlled so as not to cause a nuisance to nearby premises.
Use of the conservatory for live and recorded music shall terminate no later than 23:00 Monday to Saturday and no later than 22:30 on a Sunday.
Each socket outlet circuit or individual socket outlets used for public entertainment shall be protected by an integral residual current device (RCD) having a rated residual operating current not exceeding 30mA (0.03 amps). Every such circuit and residual current device shall be inspected and tested at intervals specified by a competent person. A satisfactory and valid inspection report shall be available on site for inspection by an authorised officer of the authority.
Alcohol shall not be sold to non-residents of the premises unless between the hours of 10:00 and 02:00. This condition shall not apply between the hours of 02:00 and 10:00 on New Year’s Day.
All staff who are involved in the sale of alcohol will receive training in relation to the licensing objectives so as to reduce crime and disorder, promote public safety, prevent public nuisance and promote the protection of children from harm. Said training will be documented and will be made available to an authorised officer upon request.
CCTV shall be installed at the premises and shall be positioned to capture a head and shoulders image of individuals entering the premises through the main public entrance.
The management will use their best endeavours to ensure that unsealed bottles and glasses are not removed from the curtilage of the premises
There shall be a “Challenge 21” policy in operation at the premises requiring any individual who appears to be under the age of 21 to produce identification to prove that they are over the age of 18, the sale of alcohol being refused where they are unable to do so. The following forms of identification are acceptable: - photocard driving licence; - valid passport; - PASS accredited Proof of Age Card; - any other form of identification previously agreed with representatives of Cumbria Constabulary Licensing Unit.
All staff who are involved in the sale of alcohol will receive suitable training in relation to the proof of age scheme upon commencement of their employment, followed by refresher training at appropriate intervals. Said training will be documented and will be made available to an authorised officer upon request.
