Annex 1 - Mandatory conditions
LA03, Section 19: Mandatory conditions where licence authorises supply of alcohol(1) Where a premises licence authorises the supply of alcohol, the licence must include the following conditions. (2) The first condition is that no supply of alcohol may be made under the premises licence:(a) at a time when there is no designated premises supervisor in respect of the premises licence, or(b) at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.(3) The second condition is that every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence. LA03, Section 22: Prohibited condition: plays(1) In relation to a premises licence which authorises the performance of plays, no condition may be attached to the licence as to the nature of the plays which may be performed, or the manner of performing plays, under the licence. (2) But subsection (1) does not prevent a licensing authority imposing, in accordance with section 18(2)(a) or (3)(b), 35(3)(b) or 52(3), any condition which it considers necessary on the grounds of public safety.
Annex 2 - Conditions consistent with the operating schedule
General description of premises:· St George's School occupies a site to the East of Harpenden Town Centre. It is surrounded on three sides by residential housing and on the fourth by Carlton Road and then the railway line. · The school is a voluntary-aided secondary school. The buildings and the land on which the buildings stand are owned by the Foundation Company, St George's School (Harpenden) Limited. The playing fields, though owned by Hertfordshire County Council, are under the management of the Governors of the School. · The school has pupils aged from 11 to 18, totalling some 1,170 as of Summer 06. This number is expected to grown to 1,350 over the next six years. A programme of expansion and building is underway. · Boarding pupils, number some 60 girls and 50 boys are resident at the school during term time. · During the school terms there are frequent performances of music and drama, given both by and for the pupils, but also for parents, other members of the school community, and members of the public. Regular examples of such events are the annual inter-house music and drama competitions, school concerts, which take place every term, and events such as the annual Boarders' May Ball, the PSA Christmas Dinner-Dance and the biennial PSA Summer Ball. · In the school holidays the premises are often let to external hirers, some of whom use the premises to rehearse and perform music and drama. · The school is also used for social and fundraising events, both in term time by the school community, and (subject to the school's needs) to external hirers. The latter can take place at any time of the year. Alcohol is often provided at these events. Examples are the PSA dances listed above, other PSA events such as the summer fete and quiz nights and the OGA annual reunion weekend. · For the purposes of the licence, only certain areas need to be licensed for sale of alcohol and for public performance of music or drama or for dancing. Public safety:· The Fire Authority considers the maximum permissible number of persons that may be present within the area indicated as used for licensable activities at one time are as follows:· Drama Studio Maximum 100 persons· Gym Maximum 150 persons· Sixth Form Common Room Maximum 60 persons· Old School Library and Foyer Maximum 110 persons · School Library Maximum 60 persons· Dining Hall and Foyer Maximum 300 persons · Assembly Hall and Foyer Maximum 300 persons· The school have also applied to licence the School Chapel. The majority of the doors leading from this area are inward opening doors and, as a consequence of this fact, the maximum numbers of persons permitted, for licensing purposes, is 100 which includes guests and any members of staff.
