Annex 2 - Conditions consistent with the operating schedule
a) General - all four licensing objectives
1. The premises will operate as a ground floor restaurant with an ancillary bar, with waiter/waitress service to customers occupying tables for sit-down meals.
2. Recorded music shall be played indoors only.
3. Music shall be played on a 'background' basis throughout opening hours, except during live music performances.
4. All the staff shall be trained in the appropriate legislation.
b) The prevention of crime and disorder
1. Advice will be taken from local police in relation to local concerns.
2. All alcohol in the restaurant will be served to tables by waiter/waitress.
c) Public safety
1. The licence holder shall be fully aware of its responsibilities in relation to Health and Safety.
2. Risk Assessments shall be undertaken periodically.
d) The prevention of public nuisance
2. Live Music shall be limited to two-piece jazz (or similar) events, to finish no later than 10.30 pm (22.30), with windows closed during performances and limited amplification in the restaurant setting. If required, notices can be displayed reminding patrons to leave quietly and respect the local residential amenity.
e) The protection of children from harm
1. Sales of alcohol will not be made to anyone who appears to be underage, or is unable to provide sufficient proof of their age.
2. No under-16's will be allowed in the bar area.
Annex 3 - Conditions attached after a hearing by the licensing authority
1. Live music shall be performed indoors only and there shall be no more than 2 jazz (or similar) performers, usually late afternoon/evening. There shall be limited amplification in restaurant setting.
2. Late Night Refreshment shall be provided indoors only.
c) Public safety:
1. As advised by the Fire Authority, the maximum permissible number of persons that may be present within the area indicated as used for licensable activities at one time must not exceed 228, broken down as follows: 148 in the restaurant area and 80 in the bar area. The two private dining rooms indicated on the licensing plan will not be used.
d) The prevention of public nuisance:
1. There shall be no emptying, handling or movement of refuse containers or any associated activity likely to cause noise disturbance between the hours of 22.00 and 08.00 outside the perimeter of the premises.
2. A notice should be displayed at the entrance reminding patrons to leave the premises quietly.
e) Protection of children from harm:
1. Accompanied children shall be allowed only in no smoking areas, which must be separated by a closed door from smoking areas except for access and use of the toilet facilities.
