Annex 2 – Conditions consistent with the Club Operating Schedule: Conditions carried over from Licensing Act 1964 (Justices 'Club Registration Certificate') S.49(3) Licensing Act 1964:- There shall be no alteration of the rules of the club without consent of the Licensing Authority so as to authorise sales of intoxicating liquor not already authorised under the rules except such sales as permitted by S.49(4) of the Act.
Indoor Sports Events:- Darts, Pool, Snooker Finals with spectators possible very occasionally dependent on club premises being the selected venue. Live Music:- Indoors only. Musical and comedy acts with live or recorded music once or twice a week. Recorded Music:- Indoors only. Playing of DVDs/tapes may be required, music will not be amplified. Supply of Alcohol:- The premises will close 30mins after last orders are supplied within the authorised hours (paragraph 6.13 of DCMS guidance under S182 LA2003)
Additional Steps taken to promote the four licensing objectives: General:- CCTV surveillance camera monitors arrivals and departures at the main club door. The club management, steward and bar staff are informed of the Licensing Act 2003 objectives and statutory requirement to comply with all relevant provisions of the Act. The Prevention of Crime and Disorder:- Club constitution includes rules governing the conduct of members and their guests within and adjacent to the club premises. Admission to the club is confined to members and bona fide guests and controlled through a computerised door entry system, guests arriving unaccompanied are scrutinised via CCTV before admission and signing in by the host member. Club employees are instructed not to admit or serve members and guests who behave in a drunk and disorderly fashion. Misconduct is reported to the committee to consider action under the club's disiplinary code. Public Safety:- The club complies with Health and Safety and Fire Precautions regulation. Following risk assessment, preventative and control measures are in place to ensure the safety of members, guests, employees, and entertainers while on the premises. The club complies with advised capacity limits. Fire action notices are posted; emergency escape routes are signposted. The Prevention of Public Nuisance:- Signage is displayed near exits requesting members and guests to respect the needs of local residents by quietly leaving the premises and car park. When live or recorded music is played all reasonable steps are taken to avoid disturbance to neighbouring properties. The Protection of Children from Harm:- Persons under age 18 are only allowed in the club if accompanied by an adult member. Door control ensures that children seeking admission to the club for any purpose are accompanied by an adult member. The prevention of public nuisance
1. The rear garden will be cleared of customers by 10.30pm. This will not apply to smokers who will be able to smoke at any time, but they are not permitted to take drinks outside.
2. After the garden has closed at 10.30pm, no drinks will be permitted to be taken into the garden area.
3. Between the hours of 8pm and 10:30pm, a responsible member of the club committee or bar staff, will check the rear garden to ensure that nuisance to nearby residents is minimised. 4. At the exit to the premises and the exit to the rear garden, the licence holder will affix signs that are clearly visible and state "please be considerate and respect our neighbours". The prevention of crime and disorder 5. A CCTV system comprising of a multi camera system will be installed at the premises capable of the following: a. The head unit (recorder) for storing the images will store such data on a hard drive or a similar quality medium (locally or accessible from a central location, this can be cloud based storage) b. If a head unit (recorder) is kept on the premises it must be located in a secure cabinet or other secure area, if the system is cloud based access must be available to at least one person on the premises when in operation. c. A CD/DVD burner, USB type device or media storage database (i.e. Cloud) will also form part of the system to facilitate making copies of the footage d. The quality of the images must be of a sufficiently high standard to allow identification of the subject matter e. Cameras will cover key areas identified by the operator and Police. These will include clear headshots of persons entering the premises, any till areas, areas where alcohol is displayed for sale and external areas used for the consumption of alcohol f. Images must be retained for a minimum period of 31 days before overwriting g. The images will be made available within a reasonable time on demand by the Police and authorised officers of St Albans City and District council. h. At all times when the premises are open there shall be at least one person who is capable of operating the CCTV system if required to do so by the Police or authorised officers of St Albans City and District council. i. 7. The premises shall operate a challenge 25 style policy. Anyone attempting to purchase alcohol who appears under the age of 25 years shall be required to produce valid photo ID (such as a photo card driving licence, passport or PASS accredited age verification card) to prove they are 18 years or older. Failure to produce acceptable ID shall result in a refusal of the sale. This refusal shall be documented in the refusals / incident log. 8. 9. All staff involved in licensable activity shall receive training relating to age verification, the licensing objectives and laws relating to the sale of alcohol. This training shall be given at the start of employment (prior to carrying out any licensable activity) and be refreshed at least every 6 months. The training shall be documented and be made available for inspection at the request of police or authorised officer of St Albans City and District council.
