Licence conditions (12)

CONDITIONS incorporating Embedded conditions/restrictions and entitlements under The Licensing Act 1964 1.1 The hours for the sale or supply of liquor shall be 07.00H to 01.00H on the following day every day of the week. Save on New Year’s Eve when the hours will run from 07.00H on New Year’s Eve through to 01.00H on the day following New Year’s Day. 1.2 The hours for the provision of plays shall be 10.00H to 23.00H every day. 1.3 The hours for the provision of live music and dancing shall be 10.00H to 23.00H every day. Save for New Year’s Eve when the hours will run from 10.00H New Year’s Eve to 01.00H New Years’ Day.
There is no prohibition on: (a) consumption of alcohol on the premises during the first sixty minutes after the above hours; and (b) the taking of alcohol from the premises during the first sixty minutes after the above hours, unless it is supplied or taken in an open vessel; and (c) Consumption of alcohol on the premises by persons taking meals there, if the alcohol was supplied for consumption as ancillary to the meal during the first sixty minutes after the hours shown in paragraph 1. (d) consumption of the alcohol on the premises or the taking or sale or supply of alcohol to any person residing in the licensed premises; (e) the ordering of alcohol to be consumed off the premises, or the despatch by the vendor of the alcohol so ordered; (f) the sale of alcohol to a trader or club for the purposes of the trade or club; (g) deleted (h) the taking of alcohol from the premises by a person residing there; or (i) the supply of alcohol for consumption on the premises to any private friends of a person residing there who are bona fide entertained by him at his own expense, or the consumption of alcohol by persons so supplied; or (j) the supply of alcohol for consumption on the premises to persons employed there for the purpose of the business carried on by the holder of the licence, or the consumption of liquor so supplied, if the liquor is supplied at the expense of their employer or of the person carrying on or in charge of the business on the premises. NB A person shall be treated as residing in any premises, notwithstanding that he occupies sleeping accommodation in a separate building, if he is provided with that accommodation in the course of a business of providing board and lodging for reward at those premises and the building is habitually used for the purpose by way of annexe or overflow in connection with those premises and is occupied and managed with those premises.
Being “exempt licensed premises” within the Late Night Refreshment Houses Act 1969, section 1(2), the premises may be kept open for public refreshment, resort and entertainment until the end of “normal evening closing time” being 30 minutes beyond the times stipulated in paragraph 1.
The playing of dominoes or cribbage in a place to which the public has access, and in respect of which a justices’ on licence is in force, is exempt from the prohibition on gaming in a public place by virtue of s.6 Gaming Act 1968.
No additional licence is required for the provision in the premises of public entertainment by the reproduction of wireless (including television) broadcasts or of programmes included in any programme service (within the meaning of the Broadcasting Act 1990) other than a sound or television broadcasting service, or of public entertainment by way of music or singing only which is provided solely by the reproduction of recorded sound General Conditions
At 23:00hrs or as soon after as reasonably practicable, the front door (as marked on the plan) will be closed. Between 23:00hrs and 01:00hrs alcohol will be served to those customers on the premises prior to 23:00hrs, those persons residing on the premises and the private friends of those residents. This condition does not prejudice the entitlements as set out in paragraph 2(h), (I), and (j) as embedded entitlements and conditions set out above. Crime and Disorder

The Applicant shall not advertise the opening hours by way of notice on the premises other than as required by the Licensing Act 2003. Public Safety Prevention of Public Nuisance
There will be a winding down period of one hour after the end of the sale and supply of alcohol on each day of the week.
Adequate steps will be in place to ensure that customers leave the premises quietly between the hours of 24.00 and 07.00.
The volume of the amplification system for any description of musical entertainment shall be strictly controlled so that noise levels are non-intrusive at the boundaries of nearby residential properties. Protection of children from harm
Adequate procedures will be in place to ensure that sales of alcohol are made to people over the age of 18.
