Licence conditions (53)

Details of Minor Variation submitted below:
1) To update and vary the layout of the premises in accordance with plans supplied by the applicant such variation to have effect upon the completion of the works as notified to the Licensing Authority in writing.
The alterations comprise removal of the disabled wc and relocated within the main toilets; step added to the raised bar area; extension of the toilet lobby areas; removal and installation of screens; new fixed seating; and reduction of bar servery counter.
2) To remove outdated / obsolete Annex 2/3 premise licence conditions, which we have highlighted on the copy premises licence uploaded with this application, for the following reasons and such variation to have immediate effect upon grant of the application:-
a. The wording under the General section is wording that was carried over from the original conversion and variation application and does not form actual conditions which binds the licence, as they are operation statements.
b. In relation to the drinks promotion condition highlighted under the Prevention of Crime and Disorder, this is now covered by a Mandatory condition and is therefore no longer necessary.
c. Wording highlighted under Public Safety, Prevention of Public Nuisance and Protection of Children from Harm are statements as to how the premises will trade and do not form actual conditions.
d. The capacity condition under Annex 3, is now covered by separate legislation and is therefore obsolete.
If any of the Statutory Authorities however have any issues with the removal of these statements/conditions then the Applicant would be happy for them to remain.
Permitted hours and licensable activities remain as existing.
Remove any retrictions which are to be placed on the licence by virtue of schedule 8, Para 6(8) of the Licensing Act 2003.
Films:- Indoors only. To permit amplified music video, sport, entertainment programmes and any entertainment of like kind (nothing of an adult nature).
Indoor Sporting Events:- May include, darts, dominoes, pool, snooker or other minor sporting games of a similar kind that may attract an audience occasionally.
Late Night Refreshment:- Indoors and Outdoors. Hot drink or food sold in conjunction with the supply of alcohol if required.
Additional Steps Taken in Order to Promote the Four Licensing Objectives:
General:-
Blackberry Jack is part of and operated by Mitchells and Butlers Group (MAB). MAB own and operate over 2000 separate managed businesses within the United Kingdom. Managers are employed by the company and operate under the direction and procedures of the company. We adopt a corporate approach to risk management across the whole estate. This ensures a consistent approach to the management of risk in each of our businesses through a range of policies, procedures and roles. This approach is fundamental to our operating principles and is integrated into the way we run our businesses.
We refer to the attached document "Mitchells and Butler - A Guide to our Policies". This document, which does not form part of this operating schedule , demonstrates our total committment to best practice policies, enforced and monitored at this site. It is not possible to submit such policies as potential conditions as they are obviously subject to other legislation, corporate responsibility considerations, and market conditions, and are therefore liable to change from time to time.
This is a variation application that does not represent a fundamental change in the way in which this premises has already been trading under its existing licences and conditions. We are required in schedule 1, part B2 to state "any additional steps that you intend to take in order to promote the four licensing objectives if the proposed variation is granted". We have carefully considered the risks and benefits associated with the additional hour(s) applied for and where additional steps are necessary and proportionate to address the licensing objectives have indicated them.
We will continue to train our staff in the standards required by the relevant legislation and as required by company policy.
Our voluntary closure policy for the operation is 30 minutes after the approved closure time for the supply of alcohol.
The Prevention of Crime and Disorder:-
The company monitors the need for door supervisors and in so doing takes into account any advice given by the Police.
The pub manager is required to actively participate in and support the local Pubwatch scheme (where active).
Text and/or radio pagers, where already used will be used for any additional hours.
Toughened glass is currently in use and will continue to be used during any additional hours.
Existing CCTV system will continue to operate during the additional hours.
In line with our Alcohol and Social Responsibility Policy there will be no promotions that encourage illegal, irresponsible or immoderate consumption.
Public Safety:-
We already understand our obligations under existing Health and Safety legislation, take our responsibilities seriously and have extensive policies and practices in place to meet these obligations (see "Guide to our Policies").
It is our opinion that the nature of the operation and proposed variation will not lead to any increase in risk of the public safety. The existing policies will simply be extended to cover the relatively small increase in opening hours. Our internal health and safety due dilligence and incident reporting system will operate during additional hour(s).
The Prevention of Public Nuisance:-
The style and nature of the operation will not differ significantly from the existing trading operation during the extended hour(s). Indeed, the grant of the additiona hour(s) will of itself promote the licensing objectives as stated at paragraph 3.29 of the Guidance, in allowing customers to emerge from premises at a more gradual rate.
Reasonable steps are taken to recognise the rights of local residents and to encourage customers to emerge from the premises quietly.
Managers are required to liase with local neighbours as part of their duties and resolve any reasonable concerns in accordance with our Role in the Community Guidelines.
The Protection of Children from Harm:
We recognise the importance of protecting children from harm and this is supported by: Our committment to health and safety in the operation and maintenance of the premises, and; Our approach to managing the risk of under-age drinking.
We will at all times observe the law and ensure that alcohol is not served to people who are under 18 years of age. The manager and staff are briefed in the importance of their responsibilities in ensuring customers are over 18.
No adult entertainment (paid for by the company of a nude physical nature) is permitted at these premises. Any children under 16 remain the responsibility of the accompanying adult when using the premises (and/or exterior area). Staff are not allowed to be in sole supervision of children which remains the responsibility of the accompanying adult at all times.
Conditions added after the Hearing:
The Prevention of Crime and Disorder:
Active representation and participation at Pubwatch.
As advised by the Fire Authority, the maximum permissible number of persons that may be present within the area indicated as used for licensable activities at one time must not exceed 200.
All amplified music, entertainment and indoor sporting events must end by 23.20 hours.
All outside areas to be cleared by 23.20 hours.
All doors and windows to be closed by 23.20 hours.
Means of communication with the licensee to be made available to the local residents associations and the Parish Council.
Signage to encourage customers to obtain taxis through the bar staff. The Sub-Committee expect that the Public House try to ensure that the taxis used do not sound their horns.
Suitable signage to be placed on the exit to Harvesters requesting that patrons use other exits after 22.00 hours.
All bottle bins to be emptied or filled between the hours of 11.00 and 21.00 hours.
Suitable and conspicuous notices to be displayed at all entrances and exits in appropriate places reminding patrons to respect the needs of local residents and to leave the premises and the area quietly.
The Protection of Children from Harm:-
No children to be in the bar at any time unless an enclosed no smoking area is provided.
