Licence conditions (32)

a) General - all four licensing objectives
1. There shall be strong management controls and all staff shall be trained to meet the premises licence requirements and the four licensing objectives, particularly with reference to:
i) No selling of alcohol to underage people (Challenge 25)
ii) No drunk and disorderly behaviour on the premises area
iii) Vigilance in preventing use and sale of illegal drugs at the retail area
iv) The CCTV installation with recording option available.
2. All staff shall receive induction and refresher training from the DPS in respect of alcohol sales and adequate training to uphold each of the licensing objectives. Training records shall be retained on the premises and made available to authorised officers of the Police Service, Licensing Authority and other responsible authorities.
b) The prevention of crime and disorder
1. There shall be no adult entertainment or services, activities or matters ancillary to the use of the premises that may give rise to concern in respect of children.
2. A CCTV System meeting the 'UK police requirements for digital CCTV systems' shall be installed to monitor all areas of the property and to record video images at all times the premises are open to the public. All recordings shall be retained for not less than 30 days and shall be made available to a Police Constable on request. A member of staff, capable of operating the CCTV system, shall be on the premises when it is trading.
3. All occasions when persons have been refused service shall be recorded in a refusals book which shall be kept in the premises for not less than 12 months. The DPS shall routinely monitor the refusals records and record that this has been done.
4. Staff will be well trained in asking customers to use the premises in an orderly and respectful manner and staff will be well trained to prevent drunkenness.
c) Public safety
1. Appropriate fire safety procedures will be in place along with appliances including fire extinguishers (Foam, H2O and CO2), fire blanket, internally illuminated fire exit signs, a smoke detector and emergency lighting. All appliances will be checked annually and will comply with relevant British Standards.
2. All fire escapes/escape routes will be clearly marked and kept free from obstructions at all times that the premises are open.
3. The doors at the rear of the premises shall be kept shut, except when it is necessary for staff to leave by these doors, during all times that regulated entertainment is taking place.
4. Emergency lighting shall be provided and internal and external lighting shall be installed in the premises.
d) The prevention of public nuisance
1. Windows shall be lockable and kept closed.
2. No live music shall be performed.
3. Prominent, clear and legible notices shall be displayed at all public exits from the premises requesting that customers respect the needs of local residents and leave the premises and surrounding area quietly. These notices shall be positioned at eye level and in a location where those leaving the premises can read them.
4. Ventilation and extract systems will be designed and maintained so as to prevent noxious smells causing a nuisance to nearby properties.
5. Reasonable steps shall be taken to recognise the rights of local residents and to encourage customers to leave the premises quietly. The licence holder shall manage customer departure. Customers will be asked not to stand around loudly talking in the street outside the premises.
6. Deliveries to the premises shall only be made during normal working hours.
7. Waste from the premises shall not be stored nor disposed of at a time or in a manner which may cause a public nuisance. Bins shall not be emptied outside the premises in the late evening, night or early morning. The placing of refuse, such as bottles, into receptacles outside the premises shall not take place between 23:00 and 07:00 hours.
8. The phone number of the manager shall be made available to near neighbours.
e) The protection of children from harm
2. No child shall be admitted to the premises unless accompanied by an adult. Any children under 16 shall remain the responsibility of the accompanying adult when using the premises (and/or exterior area). Staff will not be allowed to be in sole supervision of children who will remain the responsibility the accompanying adult at all times.
3. All staff will be trained under the licensing Act 2003. The manager and staff shall be briefed in the importance of their responsibilities in ensuring customers are over 18. Staff will strictly be told and trained to deliver alcoholic products to adults only. After the completion of the order a special polite note will be given by the staff member to the customer stating that it is illegal to buy alcohol for those who are under the age of 18.
4. All training relating to the sale of alcohol shall be documented and records kept. This record shall be made available to the Police and/or Local Authority upon request.
5. The premises shall operate the 'Challenge 25' proof of age scheme with suitable signage displayed at the point of entry and at service areas. Where a person appears to be under 25, identification in the form of passport, photo driving licence or proof of age card with the pass hologram, shall be requested and, if not provided, service of alcohol shall be refused.
6. A Record must be kept of the refusal of alcohol sales in a refusal log book.
