Licence conditions (33)
  1. Together with for the purposes of paragraph 6(5) of Schedule 8 to the Licensing Act 2003 all other licensable activities which may be carried out at the premises by virtue of the justices licence issued under the Licensing Act 1964 and existing as of the date of this licence, which include but may not be limited to the following:
  2. Public entertainment may be provided by the reproduction of wireless (including television) broadcasts or of programme included in any other service (within the meaning of the Broadcasting Act 1990) other than a sound or television broadcasting service, or public entertainment by way of music and singing only which is provided solely by the reproduction of recorded sound;
  3. ii) Private entertainment, that is to say dancing and music, may be provided and promoted for private gain;
  4. For the purpose of paragraph 6(8) of Schedule 8 to the Licensing Act 2003 this licence is subject to the effect of restrictions contained in the Licensing Act 1964 and the Children and Young Persons Act 1933,which include, but may not be limited to, the following:
  5. No child shall be employed:
  6. So long as he is under the age of fourteen years;
  7. To do any work other than light work;
  8. Before the close of school hours on any day on which he is required to attend school;
  9. Before seven o'clock in the morning or after seven o'clock in the evening on any day;
  10. For more than two hours on any day on which he is required to attend school;
  11. For more than two hours on any Sunday;
  12. Five hours in any day on which he is not required to attend school, and which is not a Sunday;
  13. For more than thirty-five hours or, if he is under the age of fifteen years, for more than twenty-five hours in any week in which he is not required to attend school;
  14. For more than four hours in any day without a rest break of one hour; or
  15. At any time in a year unless at that time he has had, or could still have, during a period in the year in which he is not required to attend school, at least two consecutive weeks without employment.
  16. ii) a) Where there is provided in any building an entertainment for children, or an entertainment at which the majority of the persons attending are children, then, if the number of children attending the entertainment exceeds one hundred, it shall be the duty of the person providing the entertainment to station and keep stationed wherever necessary a sufficient number of adult attendants, properly instructed as to their duties, to prevent more children or other persons being admitted to the building, or to any part thereof, than the building or part can properly accommodate, and to control the movement of the children and other persons admitted while entering and leaving the building or any part thereof, and to take all other reasonable precautions for the safety of the children; and
  17. Where the occupier of a building permits, for hire or reward, the building to be used for the purpose of an entertainment, he shall take all reasonable steps to secure the observance of the provisions of this section.
  18. iii) No person under the age of sixteen years, and no child aged sixteen years, shall take part in any performance to which section 37(2) of the Children and Young Persons Act 1963 applies, and in which his life or limbs are endangered.
  19. iv) No child under the age of twelve years shall be trained to take part in performances of a dangerous nature, and no child who has attained that age shall be trained to take part in such performances except under and in accordance with the terms of a licence granted and in force under section 24 of the Children and Young Persons Act 1933
  20. Between 00:30 hours and 01:30 hours, patrons may not be seated in the restaurant and can only enter the premises to collect food to take away.
  21. When the premises operates between 00:30 hours and 01:30 hours Door Supervisors will be provided and will remain on duty until the last customer has left the immediate vicinity of the premises.
  22. Between 01:30 hours and 03:00 hours the premises may operate as a takeaway delivery premises only. For the avoidance of doubt, no customers are allowed on the premises after 01:30 hours.
  23. Deliveries will only be made to a residential or business address which the customer uses in an official capacity. Deliveries shall not be made in, or to, a public place (street, park, bus stop etc).
  24. Alcohol may only be permitted to be sold with a takeaway food order after 00:30 hours where the food order is of a minimum value of £20.
  25. Alcohol shall only be sold to, and consumed by, persons taking a substantial table meal, or those waiting to be seated prior to having a table meal between 10:00 hours and 00:30 hours.
  26. The CCTV system serving the premises (in accordance with Home Office Guidelines) shall a) be maintained fully operational and in good working order at all times; b) make and retain clear images that include the points of sale of alcohol and facial images of the purchasers of the alcohol; c) show an accurate date and time that the images were made;
  27. All CCTV images shall be retained for a period of not less than 31 days.
  28. The original CCTV images shall be shown immediately upon demand to any police officer, community support officer or authorised person.
  29. The original CCTV images, or a copy, shall be provided to any police officer, community support officer or authorised person within 48 hours of a request having been made in a format that can be viewed on readily available equipment without the need for specialist software.
  30. No alcohol shall be sold if the CCTV equipment is inoperative for any reason.
  31. Notices advertising that the premises operates a "Challenge 25" scheme shall be displayed in a clear and prominent position at the inside at the premises bar servery area.
  32. A book or other form of record, a version of which must be in English, shall be kept in which shall be recorded the date, time and circumstances of a) any challenge made in accordance with the "Challenge 25" scheme. b) any disorder, ejection or other relevant incident that occurs on the premises. This book, or record, shall be kept on the premises at all times they are open and shall be made available for inspection immediately upon demand by any police or community support officer or authorised person. The Designated Premises Supervisor shall frequently check the book to ensure all staff are using it and shall sign and date it immediately after the latest entry.
  33. All staff whose responsibilities include the retail sale of alcohol shall receive training on induction and every 12 months on: a) the terms, conditions and restrictions of the Premises Licence; b) the prevention of unlawful sales of alcohol, and the likely consequence of making an unlawful sale, which shall include: i. the operation of the "Challenge 25" scheme; ii. types of acceptable ID; iii. the method of recording challenges; iv. refusing sales of alcohol to persons who appear to be drunk; and v. preventing proxy sales; c) the operation of the CCTV equipment; and d) drug awareness, which shall include training on the drugs policy applicable to the premises.
