Licence conditions (19)

CONDITIONS incorporating embedded conditions/restrictions and entitlements under The Licensing Act 1964 and The Local Government Act (Miscellaneous Provisions) Act 1982 Part II
Alcohol shall not be sold or supplied except during the following hours and regulated entertainment shall only take place during the following hours:- 1.1 10.00 hrs to 24.00 hrs Sundays to Thursday inclusive 1.2 10.00 hrs to 01.00 hrs next day following Fridays and Saturdays. 1.3 10.00 hrs to 02.00 hrs on certain occasions having given the required 14 days notice to the Licensing Authority and Police. 1.4 In addition to the above, where the day is New Year’s Eve, from the end of the terminal hours on that day, to the beginning of the commencement hour on New Year’s Day.
The above restrictions do not prohibit: (a) during the first twenty minutes after the above hours the consumption of the alcohol on the premises; (b) during the first twenty minutes after the above hours, the taking of the alcohol from the premises unless the alcohol is supplied or taken in an open vessel; (c) during the first thirty minutes after the above hours the consumption of the alcohol on the premises by persons taking meals there if the alcohol was supplied for consumption as ancillary to the meals; (d) consumption of the alcohol on the premises or the taking or sale or supply of alcohol to any person residing in the licensed premises: (e) the ordering of alcohol to be consumed off the premises, or the despatch by the vendor of the alcohol so ordered: (f) the sale of alcohol to a trader or club for the purposes of the trade or club; (g) “deleted” (h) the taking of alcohol from the premises by a person residing there; or (i) the supply of alcohol for consumption on the premises to any private friends of a person residing there who are bona fide entertained by him at his own expense, or the consumption of alcohol by persons so supplied; or (j) the supply of alcohol for consumption on the premises to persons employed there for the purpose of the business carried on by the holder of the licence, or the consumption of liquor so supplied, if the liquor is supplied at the expense of their employer or of the person carrying on or in charge of the business on the premises. n.b.: A person shall be treated as residing in any premises, notwithstanding that he occupies sleeping accommodation in a separate building, if he is provided with that accommodation in the course of a business of providing board and lodging for reward at those premises and the building is habitually used for the purpose by way of annexe or overflow in connection with those premises and is occupied and managed with those premises.
Being “exempt licensed premises” within the Late Night Refreshment Houses Act 1969, section 1(2), the premises may be kept open for public refreshment, resort and entertainment until the end of “normal evening closing time” being 30 minutes beyond the times stipulated in paragraphs 1 and 2 above, depending which applies.

The playing of dominoes or cribbage in a place to which the public has access, and in respect of which a justices’ on licence is in force, is exempt from the prohibition on gaming in a public place by virtue of s.6 Gaming Act 1968.
No additional licence for music and singing is required for the provision in the premises of public entertainment by the reproduction of wireless (including television) broadcasts, or of programmes included in any programme service (within the meaning of the Broadcasting Act 1990), other than a sound or television broadcasting service, or of public entertainment by way of music and singing only which is provided solely by the reproduction of recorded sound.
Fire and Safety 7.1 The Premises Licence Holder shall ensure compliance with the fire precautions and safety measures required by the Chief Fire Officer, as set out in the attached schedule and any conditions which may from time to time be required by the Chief Fire Officer and which have been notified to the Premises Licence Holder by the licensing authority. 7.2 Stewards: The minimum number of stewards present when members of the public are present shall be: (i) up to 100 persons - 2 stewards (ii) for each additional 50 persons or part thereof - 1 steward. Each steward shall be readily identifiable to members of the public and shall be instructed and trained in the following: (i) The action to be taken upon discovering a fire. (ii) The position of the exits. (iii) the operation and location of the emergency lighting and fire fighting equipment. (iv) Raising the alarm and correct method of calling the Fire Brigade. (v) Evacuation of the public in the event of an emergency. 7.3 Fire procedure: The Fire Brigade shall be immediately called to any outbreak of fire, however slight. 7.4 Exits: All doors indicated as exits on the attached plan shall be maintained so that they open easily and fully and the following shall apply as appropriate: a) Exit doors shall only be secured in such a manner that they can be immediately and easily opened from within. b) Exit doors which do not open outwards shall be secured in the open position when members of the public are present. c) Exit doors and the external routes therefrom shall be maintained clear and unobstructed and illuminated when members of the public are present. d) Illuminated Exit signs and notices shall be properly maintained and free from obstruction. 7.5 Means of Escape: All parts of the premises used for means of escape in case of fire, shall be kept entirely free from obstruction, whether permanent or temporary, so as not to impede safe evacuation of the premises. 7.6 Floors and Floor Coverings, shall be properly

All parts of the areas covered by the Premises Licence shall be open to free ingress and inspection upon presentation of satifsfactory identification and upon reasonable notice by:- ) Authorised officers of the Licensing Authority, and ) Police officers of the Suffolk Constabulary, and ) Fire officers of the Suffolk Fire Authority
The Premises Licence Holder shall maintain public liability insurance of not less than £5 million per claim. Crime & Disorder
Floodlights are situated in areas around the premises and the car park. These will be maintained and illuminated when required. Public Safety
On those occasions when disabled or handicapped persons are present on the licensed premises, the licensee shall make such special arrangements as necessary in the circumstances to ensure that all persons leave safely in the event of a fire.
The fire alarm system shall be tested weekly.
The emergency lighting systems shall be tested monthly.
The details of testing of the fire alarm and emergency lighting systems shall be kept in a log book which shall be kept at the premises.
Prevention of Public Nuisance
The volume of the amplification system for any description of musical entertainment shall be strictly controlled so that noise levels are non-intrusive at the boundaries of nearby residential properties.
A responsible person shall monitor the music levels outside the building, and implement any changes to reduce the noise levels in accordance with any request by an authorised office of the Council immediately and ensure that volume is maintained at the reduced level.
