Licence conditions (29)

Alcohol shall not be sold or supplied except during permitted hours.
In this condition, permitted hours means: g. On New Year’s Eve from the end of permitted hours on New Year’s Eve to the start of permitted hours on the following day (or, if there are no permitted hours on the following day, midnight on 31 December).
The above restrictions do not prohibit: c. the consumption of the alcohol on the premises by persons taking meals there during the first 30 minutes after the above hours, if the alcohol was supplied for consumption ancillary to those meals; d. the consumption of the alcohol on the premises by, or, the taking, sale or supply of alcohol to any person residing in the licensed premises; e. the ordering of alcohol to be consumed off the premises, or the despatch by the vendor of the alcohol so ordered; f. the sale of alcohol to a trader or club for the purposes of the trade or club; g. The sale or supply of alcohol to any canteen or mess, being a canteen in which the sale or supply of alcohol is carried out under the authority of the Secretary of State or an authorised mess of members of Her Majesty’s naval, military or air forces; h. the taking of alcohol from the premises by a person residing there; or i. the supply of alcohol for consumption on the premises to any private friends of a person residing there who are bona fide entertained by him at his own expense, or the consumption of alcohol by persons so supplied; or j. the supply of alcohol for consumption on the premises to persons employed there for the purposes of the business carried on by the holder of the licence, or the consumption of liquor so supplied, if the liquor is supplied at the expense of their employer or of the person carrying on or in charge of the business on the premises. SUPPER HOURS CERTIFICATE - Licensing Act 1964, S 68 Alcohol may be sold or supplied [for one hour following the hours set out above and][on Christmas day, between 3pm and 7pm] to persons taking table meals in the premises in a part of the premises usually set apart for the service of such persons and for consumption by such a person in that part of the premises as ancillary to his meal. For other purposes or in other parts of the premises the hours set out above shall continue to apply. General conditions
The Licensee will not adopt any drink promotion activities that undermine a policy of responsible drinking.
The extenal seating area in front of the premises shall only be in use between 10am and 9pm everyday. It can also only be used whilst a traffic prohibition order, issued by Suffolk County Council, is in place. Prevention of crime and disorder
Licensed SIA door staff will be employed for special events.
The Licensee will display any notices relating to crime prevention at the request of Suffolk Constabulary.
Text/pager equipment to be kept in working order at all times. Pager links to be activated, made available to and monitored by the designated premises supervisor or a responsible member of staff at all times that the premises are open to the public. Any police instructions/directions to be complied with whenever given. All instance of crime or disorder to be reported via the text/radio pager link by the designated premises supervisor or a responsible member of staff to an agreed police contact point.
The Licence holder shall ensure all alcohol sales (for takeaway/delivery orders) will be ancillary to food sales. There will be no deliveries of alcohol only and the volume of alcohol delivered will be strictly limited.
The Licence Holder shall ensure that alcohol is not left unattended at the delivery address - if the customer is not available to receive the order then the delivery is returned to the premises.
The external seating area in front of the premises will be under constant supervision when operational from both inside and outside the premises.
Two CCTV cameras monitor and record activity directly over the external seating area in front of the premises 24/7. Customers will be made aware that CCTV is in constant operation. Public safety
The Licensee will ensure that all exits, and escape routes are clearly identified, kept free from obstruction and available for immediate use in the event of an emergency during licensable activities.
The Licensee will ensure that the Fire Brigade is called immediately in the event of a fire, however slight, and the details recorded in a Fire Log-Book.
The Licensee will provide a fire alarm and smoke detector systems and maintain it in good working order.
The Licensee will clearly display a fire evacuation policy on the premises.
The Licensee will ensure that all soft furnishings are fire retardant treated and provide copies of certificates on request to any authorised officer.
The Licensee will ensure that an adequate and appropriate supply of first aid equipment and materials are available on the premises.
The furniture in the external seating area at the front of the premises, will be study and well-fixed to avoid them being able to be dislodged by the wind.
There will be good segregation from the highway and the external seating area in front of the premises. Prevention of public nuisance
The volume of the amplification system for any description of musical entertainment shall be strictly controlled so that noise levels are non-intrusive at the boundaries of nearby residential properties.
A responsible person shall monitor the music levels outside the building and implement any changes to reduce the noise levels in accordance with any request by an authorised office of the Council immediately and ensure that volume is maintained at the reduced level.
After 23:30hrs all external doors and windows must be kept closed, other than for access and egress when amplified music and amplified speech is taking place.
All external areas shall not be used after 23:30hrs.
Concerning the external seating area in front of the premises, signage will be displayed requesting customers to be respectful of residents. Staff will be directed to be extra vigilant in terms of monitoring noisy, anti-social or disrespectful behaviour. As requested on the variation application (March 2022) and meaning that Section 177A of the Licensing Act 2003 dos not apply to the following condition:
The external seating area in front of the premises, will not be used for playing music or any other public events. Protection of children from harm
All members of staff at the premises will seek PASS accredited proof of age cards, photo-driving licences or passports as proof of age evidence from any person who appears to be under the age of 18 and who is seeking to purchase or consume alcohol on and off the premises.
The Licence holder shall ensure ID verification will be made when all orders containing alcohol are delivered (no ID no delivery) - acceptable proof of age shall include identification bearing the customer’s photograph, date of birth and integral holographic mark or security feature.
Any children using the external seating area at the front of the premises, for meals and soft drinks will need to be under the direct constant supervision of their parents or carers.
