Licence conditions (35)
  1. The premises licence holder shall submit to Hampshire County Council and/or Havant Borough Council a detailed Event Management Plan not less than 90 days prior to the commencement of any event. The Event Management Plan shall be produced in all cases and shall include a site plan and shall take account of the advice and requirements contained in 'The Event Safety Guide' (HSG195, published by the Health & Safety Executive), 'Temporary Demountable Structures: Guidance on procurement, design and use' (published by the Institution of Structural Engineers) and any other statutory and other guidance including local guidance.
  2. Park Management and/or the constituent bodies of the Safety Advisory Group will determine what may be a reasonable time for their consideration of any information required to be supplied to them by the premises licence holder.
  3. The premises shall not be used by the premises licence holder unless permission is given by a duly authorised officer of Hampshire County Council. Such arrangement shall made in writing and confirm the date(s) for which permission to use the premises is given and contain the terms and conditions of hire. The contractual agreement must be signed by both parties and be in place at least 28 days in advance of the date of the event. The premises licence holder shall comply with the contractual terms and conditions and the conditions of this premises licence. In the event that the contractual terms and conditions are more restrictive than the conditions attached to the premises licence, the premises licence holder shall abide by the terms and conditions as if they were conditions of the premises licence.
  4. All staff engaged in the sale of alcohol shall be aged at least 18 years
  5. Staff engaged in the sale of alcohol shall be instructed as to their legal responsibilities in relation to the sale of alcohol to persons under the age of 18 years and to persons who are drunk. A written record shall be made of any such training, and the record shall be produced to a police officer or responsible officer of the local authority on request.
  6. A written record shall be made of every incident of crime and disorder taking place on the premises, to include any action taken by staff. Every entry in the record shall be signed and dated by the person making it. This record shall be produced to a police officer or an authorised officer of the local authority on reasonable request.
  7. A refusals / ID checks or computer record shall be maintained by staff. These records shall be retained for a minimum of 1 year and be made available to the Police and Council upon request.
  8. No beverages shall be sold or supplied in any glass container and plastic/polycarbonate or recyclable vessels shall be used.
  9. No alcohol sold for consumption on the licensed site shall be sold in a sealed container.
  10. Clear signage (or posters) shall be displayed at every bar servery area to alert customers and staff to the age-verification policy in place for the sale of alcohol.
  11. Clear signage conveying an anti-drugs message shall be displayed within the event site.
  12. The licence holders shall permit any reasonable and lawful enforcement activity by police for the purpose of preventing or detecting the unlawful possession or use of illegal drugs on the event site.
  13. The number of SIA door supervisors to be engaged on any occasion shall be determined by the licence holder, taking into account such factors as the nature and duration of licensable activities proposed, the number, age and character of persons likely to attend, and any known risks to impact on the promotion of the licensing objectives. The licence holder shall make a written record of the number of door supervisors to be engaged and the factors taken into account by the licence holder. Any such record shall be produced to a police officer or authorised officer of the local authority on reasonable request.
  14. The Designated Premises Supervisor, or an appointed deputy (who holds the written authorisation of the DPS), will be on the premises when there are any licensable activities taking place.
  15. The holder of the premises licence, or an agent on behalf of and with the authority of the licence holder, must produce a formal document, currently titled Event Management Plan, addressing methods by which the licence holder proposes to manage the following matters to ensure the licensing objectives are promoted: a) the structure for the operational management of the event, including the composition and functions of any event liaison team or similar b) the responsibilities of personnel engaged at the site c) ticket sales and conditions of entry d) procedures for the security of and issuing of tickets and wristbands e) verification and regulation of the number of persons present on the event site f) the safe and orderly ejection of persons from the site g) the number and deployment of security staff and stewards h) crowd safety i) the reduction of crime and prevention of the supply/possession of drugs, safe handling of drugs by staff j) the responsible sale of alcohol k) the safety of temporary structures l) the prevention of fire m) the use of fireworks n) procedures in the event of emergency o) the provision of first aid p) accident reporting procedures q) the welfare of persons attending and working within the event site r) the control of noise and the prevention of public nuisance s) the control of litter and the disposal of waste; t) sanitation provisions and the disposal of waste u) provision of water and the disposal of waste water v) the safety of food w) missing persons, the safety of children, lost children and safeguarding x) provision of facilities for disabled persons y) contingency planning in the event of adverse weather or ground conditions z) traffic management
  16. A draft version of the Event Management Plan shall be circulated to all responsible authorities, and to the licensing authority (Havant Council), not later than 90 days before the start of any event. The Event Management Plan (and any appendices) will clearly indicate a version number (or equivalent) and the date it was produced/modified
  17. Following the circulation of the draft Event Management Plan, the licence holder, or an agent on behalf of and under the authority of the licence holder, shall consult with all responsible authorities and shall take due account of any representation made by a responsible authority regarding the content of the document.
  18. The Event Management Plan shall be finalised not later than 28 days before the start of an event and shall be circulated in final form to all responsible authorities and to the licensing authority.
  19. Where, following the submission of the final version of the Event Management Plan but prior to the commencement of the event, the licence holder considers it necessary to make any adjustment to the Event Management Plan, the proposed adjustment shall be notified to the licensing authority, who may notify the relevant responsible authority. No adjustment shall be made to the Event Management Plan unless it is agreed with the licensing authority.
  20. The Event Management Plan and any appendices form part of the operating schedule for this licence and therefore the details specified therein are to be treated as conditions of this premises licence. Where a person placed under a positive obligation to comply with a provision of the Event Management Plan (or its appendices) fails to do so, the failure shall be regarded as a breach of this condition of the premises licence.
  21. Where, during the course of the event, the licence holder considers it necessary to deviate from any provision within the Event Management Plan (or its appendices), the matter shall be brought to the attention of representatives of the relevant responsible authority or authorities within the Event Liaison Team (or equivalent) who may approve such deviation. Any such decision shall be documented by the Event Liaison Team.
  22. Or if no ELT - Where, during the course of the event, the licence holder considers it necessary to deviate from any provision within the Event Management Plan, any such decision shall be documented by the licence holder (or someone on their behalf) including the reasons for the deviation.
  23. Where applicable, The sale and consumption of alcohol will continue only to artists, crew and sponsors after the public bars have closed.
  24. No licensable activity shall take place unless the number of stewards and security personnel for the event is agreed with the premises licence holder by the police no later than 7 days before the event is planned to open to the public.
  25. If, within 7 days of then planned opening of the event to the public, the police are of the opinion that any of the conditions relating to public order are not complied with or will not be complied with they shall inform Hampshire County Council's relevant officers.
  26. The Event Management Plan shall take full account of public safety and in particular independent safety checks shall be made to all temporary structures erected on site and to the perimeter fencing and crush barriers by competent persons agreed by the Hampshire County Councils Officer for Health & Safety not more than 7 days before the planned opening of the site to the public.
  27. The site plan shall show the location of an adequate number of designated appropriately staffed and effectively signed Emergency Exits.
  28. The location of any First Aid facilities considered necessary shall also be shown on the site plan.
  29. A Site Evacuation Procedure shall be prepared as part of the Event management Plan for each event and all security staff, stewards and other event staff shall be fully briefed and made aware of its provisions.
  30. The premises licence holder must carry a minimum of £10 million Public Liability Insurance to the satisfaction of the Council's Head of Leisure and Cultural Services to indemnify Hampshire County Council against all public liability risks in connection with the use of the premises and land to which this licence applies.
  31. All live music events shall close at 22:00 hours. Events shall be supervised by stewards and SIA registered security staff. Where appropriate, noise monitoring will be undertaken by the premises licence holder, both on site and at the perimeter of the site, to minimise the nuisance to residents living close to the venue.
  32. Amplified voice and music volume sound levels and the means of control and monitoring sound levels shall be included in the Event Management Plan and agreed by the Havant Borough Council's Head of Environmental Health. The term 'amplified music' shall include recorded music and radios, musical instruments through the use of an amplifier, amplified voices through the use of a microphone and amplifier or through a public address system. The term 'amplified music' shall also include the playing of acoustic instrument where its output is enhanced using any amplifier or microphone and amplifier.
  33. Risk assessments will be undertaken for all events and as a result steps will be taken to avoid public nuisance being caused to residents in the immediate and surrounding areas.
  34. Where any event is planned to last for more than one day, event staff, trade stall holders and other personnel on site after the event has closed to the public shall not be permitted to play any amplified music, radios or amplified recorded music overnight
  35. A specific part of the Event Management Plan shall fully explore and identify the potential for any risk or harm to children. The necessary monitoring activities and procedures will be put in place to address the issues identified.
