Conditions carried over from: Licensing Act (Justices 'On' Licence)
Conditions carried over from the Local Government (Miscellaneous Provisions) Act 1982, and also:
This Licence is subject to the provisions of the said Act, to the Regulations and Conditions now or from time to time made by the above Council and to any Additional Conditions included on this Licence.
ADDITIONAL CONDITIONS
1) The electrical installation shall be inspected at least once in every five years, or such lesser period as is considered appropriate to the individual case, by a competent electrical engineer appointed by or on behalf of the licensee of the premises and a certificate stating the condition of the installation shall after each inspection, be forwarded to the Council by or on behalf of the licensee of the premises.
2) The number of persons (excluding staff and attendants) to be allowed at any one time in the licensed premises shall not exceed: 150
3) The conditions of public use under the Licence are varied as follows:
a) One evening per month from 19.00hrs until 23.00hrs between the months of January to November inclusive.
b) on two occasions during the month of December until such hour as may be granted by the Licensing Justices.
4) An electronic noise-limiting device shall be fitted and set at such a level as to render any music inaudible outside the curtilage of the premises.
5) The side passage leading to the external gate shall be kept clear of all obstruction and trip hazards.
Conditions carried over from the Cinemas Act 1985 and the Sunday Entertainment Act 1932 (as amended) and also:
This Licence is subject to the Regulations made by the Secretary of State under Section 4 of the Act and to Regulations made from time to time by the Council, also to any Additional Conditions included on this Licence.
This Licence does not constitute the consent of the Council under Section 2 of the Act of 1985.
This licence is restricted to a digital satellite video jukebox, which transmits a picture and sound via a satellite dish. An annual Public Entertainment Licence is issued for the premises.
Annex 1 - Mandatory conditions
LA03, Section 19: Mandatory conditions where licence authorises supply of alcohol
(1) Where a premises licence authorises the supply of alcohol, the licence must include the following conditions.
(2) The first condition is that no supply of alcohol may be made under the premises licence:
(a) at a time when there is no designated premises supervisor in respect of the premises licence, or
(b) at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.
(3) The second condition is that every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
LA03, Section 20: Mandatory condition: exhibition of films
(1) Where a premises licence authorises the exhibition of films, the licence must include a condition requiring the admission of children to the exhibition of any film to be restricted in accordance with this section.
(2) Where the film classification body is specified in the licence, unless subsection (3)(b) applies, admission of children must be restricted in accordance with any recommendation made by that body.
(3) Where:
(a) the film classification body is not specified in the licence, or
(b) the relevant licensing authority has notified the holder of the licence that this subsection applies to the film in question,
admission of children must be restricted in accordance with any recommendation made by that licensing authority.
(4) In this section:
"children" means persons aged under 18; and
"film classification body" means the person or persons designated as the authority under section 4 of the Video Recordings Act 1984 (c. 39) (authority to determine suitability of video works for classification).

The prevention of crime and disorder:
" Providing a 30 minute extension of opening hours after the end of the sale of alcohol will promote this objective as the last drink will be consumed less quickly, with access to the pub toilets and with access to non-alcoholic refreshment during the wind down period
" Not less than 10 working days notice will be provided to police when Event Days are planned. The police shall have the power to veto any event they reasonably believe will harm the crime and disorder objective, by responding within 5 days
" The DPS will be a member of the St Albans Pubwatch so long as it exits
Public safety:
" There is no identified risk of crowding
The prevention of public nuisance:
" Live music will cease at 23.00 any day except on Christmas Eve and New Years Eve.
" The Garden will be closed at or before 23.30
" All windows will be kept closed after 23.00 and doors will be kept closed except as required for access and egress
" Recorded music will be reduced to background level during the wind down period
" A notice will be placed prominently at the exits asking patrons to leave quietly
The protection of children from harm:
" The restrictions set out in the Licensing Act 2003 will apply
" Photographic proof of age will be required of anyone seeking to buy alcohol who appears to be under 20 years of age.
Annex 3 - Conditions attached after a hearing by the licensing authority
" Active representation and participation at Pubwatch
" As advised by the Fire Authority, the maximum permissible number of persons that may be present within the area indicated as used for licensable activities at one time must not exceed 150
" Live music, including karaoke, recorded music and amplified voice to be linked to the noise limiter, and the noise limiter to be set at such a level that is agreed by the Environmental Health Department.
" All doors and windows to be kept closed during live music and amplified voice except during egress and ingress.
" No glassware or open bottles to be taken out into the street or car park.
" No music to be played in or transmitted to the outside area.
" Means of communication with the licensee to be made available.
" Licensee, DJ and staff to remind customers that they are in a residential area and to leave quietly.
" The garden to be cleared by 23.00 hours.
" No children allowed in the building unless a no smoking area is provided completely separated by a closed door from smoking areas.
" All under 18s will be excluded from the premises before any videos or TV transmissions are shown that are unsuitable for children under 18
