  20. Conditions carried over from Licensing Act 1964 (Justices 'on' Licence) and
  21. Local Government (Miscellaneous Provisions) Act 1982 (Public Entertainment Licence).
  22. LICENSING OF PUBLIC ENTERTAINMENT
  23. Under the provisions of the Local Government (Miscellaneous Provisions) Act 1982:
  24. Public music and dancing and public entertainment of the like kind on Saturday between the hours of 20.30hrs and 23.00hrs.
  25. This Licence is subject to the provisions of the said Act, to the Regulations and Conditions now or from time to time made by the local Council and to any Additional Conditions included on this Licence.
  26. Additional Conditions
  27. 1) The electrical installation shall be inspected at least once in every five years, or such lesser period as is considered appropriate to the individual case, by a competent electrical engineer appointed by or on behalf of the licensee of the premises and a certificate stating the condition of the installation shall after each inspection, be forwarded to the Council by or on behalf of the licensee of the premises.
  28. 2) The number of persons (excluding staff and attendants) to be allowed at any one time in the licensed premises shall not exceed:
  29. Lounge Bar - 80 Persons
  30. 3) Not less than fourteen days notice shall be given to the Licensing Authority of any proposed event taking place in the garden under the terms of this licence.
  31. 4) Admission to all parts of the licensed areas shall be given at all reasonable times, either during or other than during an event, to authorised officers of the Pollution Team, even without prior notice.
  32. 5) The licence holder or anyone involved in the organisation of entertainment (including those controlling the volume of music) shall ensure that any noise emanating from the premises is such as not to cause annoyance or disturbance to residents in the locality.
  33. 6) Music noise and noise from voices emanating from the premises shall be inaudible at any point between the positions A-B and C-D identified on the plan at Appendix 1 at all times during a licensed event.
  34. 7) No external loudspeaker systems shall be installed without the prior approval in writing of the Environment and Health Department.
  35. Advisory Note
  36. The Applicant should note that monitoring of the noise from a licensed event may be undertaken by Officers from the Council.
  37. Additional Steps Taken in Order to Promote the Four Licensing Objectives:
  38. General:-
  39. Following an assessment of the premises and its surrounding area the following is proposed: 30 minute "drinking up" time will allow appropriate dispersal, use of lavatories etc. In order to further the licensing objectives the licensee reserves the right to move the fire appliances, AWP machines, cigarette machines and or any other similar objects temporarily in a fixed location which may impact on the ability of individuals on the premises to use exits or escape routes without impediment.
  40. The Prevention of Crime and Disorder:-
  41. Lighting to all external areas including the garden. Members of pub watch. Most customers are local.
  42. Public Safety:-
  43. Health and Hygiene certificate. Fire fighting equipment. Smoking charter displayed.
  44. The Prevention of Public Nuisance:-
  45. Majority of doors and windows are closed when live music is on. Fabric of building retains sound. Managed customer departure.
  46. The Protection of Children from Harm:-
  47. No unaccompanied children and no children after 21.00. No striptease or nudity.
  48. Conditions added after a hearing:
  49. Active representation and participation at Pubwatch meetings from the White Hart Tap Public House
  50. The Prevention of Publice Nuisance:-
  51. Recorded music should be at a level not audible outside the premises
  52. No music to be played in or transmitted to the outside area
  53. The outside areas to be closed by 23.00 hours
  54. Windows and the garden/back door to be closed by 23.20 hours
  55. Suitable and conspicuous notices to be displayed both inside and outside requesting that customers leave quietly
  56. Licensee, DJ and staff to remind customers that they are in a residential area and to leave quietly.
  57. No children to be allowed in the bar at any time
  58. Accompanied children may be in the outside seating area until 21.00 hours.
