Annex 1 - Mandatory conditions:
Conditions carried over from the Licensing Act 1964 (Justices 'On' Licence and Supper Hours Certificate). Conditions carried over from the Local Government (Miscellaneous Provisions) Act 1982 and also:
This Licence is subject to the provisions of the said Act, to the Regulations and Conditions now or from time to time made by the above Council and to any Additional Conditions included on this Licence.Additional Conditions
1) The electrical installation shall be inspected at least once in every five years, or such lesser period as is considered appropriate to the individual case, by a competent electrical engineer appointed by or on behalf of the licensee of the premises and a certificate stating the condition of the installation shall after each inspection, be forwarded to the Council by or on behalf of the licensee of the premises.
2) The number of persons (excluding staff and attendants) to be allowed at any one time in the licensed premises shall not exceed: Bar (General) - 150Bar Area (Nearest Car Park) - 603) (Removed)
4) The licence holder shall provide the Council with the contact details (name and telephone number etc) of the licence holder or anyone else involved in the organisation of the event, who can be contacted whilst the premises are open.
5) Admission to all parts of the licensed areas shall be given at all reasonable times, either during or other than during an event, to authorised officers of the Pollution Team, even without prior notice.
6) The licence holder or anyone involved in the organisation of entertainments (including those controlling the volume of music) shall ensure that any noise emanating from the premises is such as not to cause annoyance or disturbance to residents in the locality.LA03, Section 19: Mandatory conditions where licence authorises supply of alcohol
(1) Where a premises licence authorises the supply of alcohol, the licence must include the following conditions. (2) The first condition is that no supply of alcohol may be made under the premises licence:
(a) at a time when there is no designated premises supervisor in respect of the premises licence, or
(b) at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.
(3) The second condition is that every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
LA03, Section 21: Mandatory condition: door supervision
(1) Where a premises licence includes a condition that at specified times one or more individuals must be at the premise to carry out a security activity, the licence must include a condition that each such individual must be licensed by the Security Industry Authority.
(2) But nothing in subsection
(1) requires such a condition to be imposed:
(a) In respect of premises within paragraph 8(3)(a) of Schedule 2 to the Private Security Industry Authority Act 2001 (c. 12) (premises with premises licences authorising plays or films), or
(b) In respect of premises in relation to:
(i) Any occasion mentioned in paragraph 8(3)(b) or (c) of that Schedule (premises being used exclusively by club with club premises certificate, under a temporary event notice authorising plays or film or under a gaming licence), or
(ii) Any occasion within paragraph 8(3)(d) of that Schedule (occasions prescribed by regulations under that Act).
(3) For the purposes of this section:
(a) "security activity" means an activity to which paragraph 2(1)(a) of that Schedule applies, and
(b) paragraph 8(5) of that Schedule (interpretation of references to an occasion) applies as it applies in relation to paragraph 8 of that Schedule.
Annex 2 - Conditions consistent with the operating schedule:

Remove the following conditions:
· To remove the restrictions and effects of Section 168 and 171 Licensing Act 1964 so as to allow the provisions under the Licensing Act 2003 to apply in relation to children
· To remove the restrictions on consumption of alcohol as set out in Section 63(1) Licensing Act 1964 (drinking up time).
· To remove the restrictions on credit sales in place by Section 166 Licensing Act 1964
· To extend the terminal hour at the premises in respect of the sale of alcohol and other licensable activities.
General - all 4 licensing objectives:
· We have applied for an extended period between the cessation of the supply of alcohol and the closure of the premises to give us the option to allow for a more gradual dispersal of customers. The style and operation of the pub will not differ significantly during the extended hours. Non-alcoholic refreshment will be available in the extended period.· The premises will respect Spirit Group's Approach to Responsible Drinking (a copy of which is enclosed in support of this application). Our policies change at regular intervals to reflect current trends and it would be inappropriate to standardise them on a permanent basis. The enclosed policy is included for information only and not as suggested conditions or to form part of any other operating schedule.
The prevention of crime and disorder:
· When door staff are used they will be Security Industry Authority (SIA) approved and operate in accordance with the security industry guidelines.
· A zero tolerance towards illegal drugs will be enforced at all times.
· If a disc jockey is used on any night then he/she will ask customers to leave quietly.
· If a CCTV system is installed at this site, it will continue to operate during the additional hours of trading and notices will be displayed.
· All instances of crime and disorder will be reported to the police and will be kept in an incident log book.
Public safety:
· Public safety is integral to the way that the Spirit Group runs its business and is reviewed regularly through our health and safety policy. This policy is fully briefed and trained to all management and staff and we will continue to train our staff to the standards required by relevant legislation.
· Free drinking water will be available at all times.
The prevention of public nuisance:
· Additional patrols will take place by members of staff, internally and externally, to limit any noise pollution when entertainment is being offered within the premises.
· Where already used text/radio pagers will continue to be used for the additional hours of trading and will be monitored by a responsible member of staff.
· Soft drinks and non-alcoholic refreshment will be available if e decide to use the option to stay open for an extended period between the cessation of the supply of alcohol and the closure of the premises (see above under general).
The protection of children from harm:
· When children are allowed upon the premises, any entertainment offered within the premises will be suitable for young persons.
· Children will be required to be supervised by the accompanying adult at all times.
· A no smoking area will be provided
· Soft drinks and non-alcoholic drinks will be available.
· A recognised Proof of Age Policy will be enforced
Annex 3 - Conditions attached after a hearing by the licensing authority:
Public Safety:
· As per condition 2 of the Public Entertainment Licence, the maximum number of persons permissible on the premises at any one time must not exceed 210, broken down to 150 in the main bar and 60 in the bar area.
The Prevention of Public Nuisance:
· The outside area to be closed by 23.30 hours
· All windows and doors to be closed by 23.20 hours except for egress and ingress.
· All windows and doors to be closed during live music events excluding ingress and egress.
· No more than 30 live music events in any 1 calendar year on Thursday, Friday and Saturday only.
· Live music including karaoke to end by 23.00 hours.
· Means of communication with the licensee to be made available.
· No music to be played in or transmitted to the outside area.
· Suitable and conspicuous notices to be displayed at all entrances, exits and the car park in appropriate places reminding patrons it is a residential area and to leave quietly.
The Protection of Children from Harm:
· No children to be allowed in the building except for access to the garden area and for the purposes of using the toilet facilities, unless a no smoking area separated by a closed door from smoking areas is provided.
· Accompanied children allowed in the garden /patio area.
