Licence conditions (18)
  1. Minor Variation 16/3/12 -
  2. To vary the layout of the premises in accordance with plans supplied by the applicant such variation to have effect upon the completion of the works as notified to the Licensing Authority in writing
  3. To extend the opening hours of the premises (including any standard and non standard timings) to 08:00 on Monday to Sunday, in order to serve breakfast
  4. To remove the restriction on trading for both Good Friday and Christmas Day
  5. To remove the condition relating to the provision of a non smoking area as this is now obsolete
  6. The alterations comprise:-
  7. 1.Removal of step from main entrance and lengthening and widening of the ramp
  8. 2.New curved fixed seating (which does not affect access/egress
  9. Our clients wish to remove the restriction on both trading for both good Friday and Christmas Day in order that these be treated as normal days of the week.
  10. Our clients wish to also removed the condition at Annex 2 relating to the provision of a non smoking area as this is now obsolete in light of the smoking ban in place

Conditions carried over from: Licensing Act 1964 (Justices 'On' Licence) and also:· A manager/Licensee to join the local Pubwatch scheme upon the final declaration of the licence· CCTV to be installed and maintained to the satisfaction of the Police together with suitable recording equipment and such recordings to be kept for a period of one month and be made available to the police on reasonable request· Any door supervisors at the premises to be registered under any relevant local authority scheme.Conditions carried over from Local Government (Miscellaneous Provisions) Act 1982 and also:· Under the provisions of the Local Government (Miscellaneous Provisions) Act 1982:· Public music and dancing and public entertainment of the like kind on weekdays between the hours of 12 midday and 12 midnight and Thursday, Friday and Saturday until 1am. Sundays between the hours of 4.30 pm and 12.00 pm (see below).· This Licence is subject to the provisions of the said Act, to the Regulations and Conditions now or from time to time made by the local Council and to any Additional Conditions included on this Licence.· ADDITIONAL CONDITIONS1) The electrical installation shall be inspected at least once in every five years, or such lesser period as is considered appropriate to the individual case, by a competent electrical engineer appointed by or on behalf of the licensee of the premises and a certificate stating the condition of the installation shall after each inspection, be forwarded to the Council by or on behalf of the licensee of the premises.2) The number of persons (excluding staff and attendants) to be allowed at any one time in the licensed premises shall not exceed: 4003) The permitted hours of public use under the Licence are varied as follows:THURSDAY, FRIDAY and SATURDAY - 4.30pm until 1.00amSUNDAY - 4.30pm until 12.00pm
  13. Annex 1 - Mandatory conditions
  14. Licensing Act 2003, Section 19: Mandatory conditions where licence authorises supply of alcohol:(1) Where a premises licence authorises the supply of alcohol, the licence must include the following conditions. (2) The first condition is that no supply of alcohol may be made under the premises licence:(a) at a time when there is no designated premises supervisor in respect of the premises licence, or(b) at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.(3) The second condition is that every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence. LA03, Section 21: Mandatory condition: door supervision(1) Where a premises licence includes a condition that at specified times one or more individuals must be at the premise to carry out a security activity, the licence must include a condition that each such individual must be licensed by the Security Industry Authority.(2) But nothing in subsection (1) requires such a condition to be imposed:(a) In respect of premises within paragraph 8(3)(a) of Schedule 2 to the Private Security Industry Authority Act 2001 (c. 12) (premises with premises licences authorising plays or films), or(b) In respect of premises in relation to:(i) Any occasion mentioned in paragraph 8(3)(b) or (c) of that Schedule (premises being used exclusively by club with club premises certificate, under a temporary event notice authorising plays or film or under a gaming licence), or(ii) Any occasion within paragraph 8(3)(d) of that Schedule (occasions prescribed by regulations under that Act).(3) For the purposes of this section:(a) "security activity" means an activity to which paragraph 2(1)(a) of that Schedule applies, and(b) paragraph 8(5) of that Schedule (interpretation of references to an occasion) applies as it applies in relation to paragraph 8 of that Schedule.
  15. Annex 2 - Conditions consistent with the operating schedule

General - all four licensing objectives:· The conditions being removed do not promote the licensing objectives and are an onerous burden from the 1964 Act, which no longer serve any purposeThe Prevention of Crime and Disorder:· A personal licence holder to be on the premises after 23.00 when the premises are open to the public.· On occasions of music and dancing SIA registered door supervisors will be on duty in the evenings at a ratio of 1:100 members of the public.Public safety:· The management of the premises will ensure the layout of the furniture is such to allow customers to enjoy regulated entertainment in safetyThe protection of children from harm:· A no smoking area is provided within the premises. The premises were assessed under the old Act as being suitable for the accommodation of children and this has not changed. The provisions of the 2003 Act should now regulate the premises.
