EC0101 - Credit Sales (from original Justices Licence)
Alcohol shall not be sold or supplied unless it is paid for before or at the time when it is sold or supplied, except alcohol sold or supplied:
(a) with and for consumption at a meal supplied at the same time, is consumed with the meal and paid for together with the meal;
(b) for consumption by a person residing in the premises or his guest and paid for together with his accommodation;
(c) to a canteen or mess.
EC0103 - Children in bars - (from original Justices On licence) No person under fourteen shall be in the bar of the licensed premises during the permitted hours unless one of the following applies:
(1) He is the child of the holder of the premises licence.
(2) He resides in the premises, but is not employed there.
(3) He is in the bar solely for the purpose of passing to or from some part of the premises which is not a bar and to or from which there is no other convenient means of access or egress.
(4) The bar is in railway refreshment rooms or other premises constructed, fitted and intended to be used bona fide for any purpose to which the holding of the licence is ancillary. In this condition "bar" includes any place exclusively or mainly used for the consumption of intoxicating liquor. But an area is not a bar when it is usual for it to be, and it is, set apart for the service of table meals and alcohol is only sold or supplied to persons as an ancillary to their table meals.
EC0104 - Regulated Entertainment - (from original Justices Licence)
Unless otherwise specified on this licence no regulated entertainment shall take place at the premises with the exception of pre-booked private events limited to the provision of music and dancing for pre-invited guests.
No public admission or readmission to the premises after 00:00 hours.
CCTV will be installed and working to the satisfaction of the police and licensing authority, with recordings maintained for at least 1 month. If the equipment fails, the police and licensing authority must be informed as soon as possible and immediate steps will be taken to put the equipment back into service. Failure to comply could result in restrictions being levied on the premises i.e. hours of operation or restricting the number of patrons allowed on the premises. Notices are to be placed and displayed at the entrance to the premises advising that CCTV is in operation.
For the final hour of opening the music is reduced in volume and is discernibly quieter.
All alcohol will be served in toughened glasses.
Customers are not permitted to take open containers of alcoholic or soft drinks from the premises.
All bottles and glasses are removed from public areas as soon as they are finished with or empty.
The capacity limit of as stated by KFRS must be adhered to in order to prevent overcrowding, which could lead to crime and disorder.
The Designated Premises Supervisor must ensure the premises have a zero drugs policy in place and a copy is to be forwarded to the police and licensing authority.
Any irresponsible drinks promotions not permitted.
Windows and doors at the premises will be closed, other than for access/egress, after 23:00 hours.
The garden area is closed to the public after 23.00 hours.
Disposal of waste bottles into external receptacles where the noise will be audible to neighbouring properties must not occur between 21:00 and 07:00 hours.
When there is a live music performance on the premises, poly-carb glasses/vessels and/or plastic bottles are to be used for all drinks. Any drinks in glass bottles are to be decanted by staff into poly-carb glasses/vessels prior to serving. This is to include a 1 hour period prior to the start of the live music and to be continuous until closing time, regardless of intermissions or other periods when the live music isn't being performed (for example, rest breaks for the musicians).
When there is a live music performance on the premises, there will be a staff to customer ratio of 1:75, with a minimum of 4 staff on duty, regardless of this ratio. This is to operate at least 1 hour prior to the start of the live music and to be continuous until the premises is fully closed.
When there is a live music performance on the premises, there will be staff checks outside of the building at a frequency of 30 minutes. This will involve a member of staff physically going outside and making these checks. This is to operate at least 1 hour prior to the start of the live music and to be continuous until the premises is fully closed.
