Licence conditions (15)
  1. CONDITIONS incorporating Embedded conditions/restrictions and entitlements under The Licensing Act 1964
  2. The hours for regulated entertainment and the sale or supply of liquor shall be 10.00h to 24.00h each day of the week, save on New Year’s Eve when the hours will run from 10.00h on New Year’s Eve through to 24.00h on New Year’s Day.
  3. There is no prohibition on:- (a) consumption of alcohol on the premises during the first 40 minutes after the above hours; and (b) the taking of the alcohol from the premises during the first 40 minutes after the above hours, unless it is supplied or taken in an open vessel; and (c) deleted (d) consumption of the alcohol on the premises or the taking or sale or supply of alcohol to any person residing in the licensed premises; (e) the ordering of alcohol to be consumed off the premises, or the despatch by the vendor of the alcohol so ordered; (f) the sale of alcohol to a trader or club for the purposes of the trade or club; (g) deleted (h) the taking of alcohol from the premises by a person residing there; or (i) the supply of alcohol for consumption on the premises to any private friends of a person residing there who are bona fide entertained by him at his own expense, or the consumption of alcohol by persons so supplied; or (j) the supply of alcohol for consumption on the premises to persons employed there for the purpose of the business carried on by the holder of the licence, or the consumption of liquor so supplied, if the liquor is supplied at the expense of their employer or of the person carrying on or in charge of the business on the premises. N.b.: A person shall be treated as residing in any premises, notwithstanding that he occupies sleeping accommodation in a separate building, if he is provided with that accommodation in the course of a business of providing board and lodging for reward at those premises and the building is habitually used for the purpose by way of annexe or overflow in connection with those premises and is occupied and managed with those premises.
  4. Being “exempt licensed premises” within the Late Night Refreshment Houses Act 1969, section 1(2), the premises may be kept open for public refreshment, resort and entertainment until the end of “normal evening closing time” being 30 minutes beyond the times stipulated in paragraph 1 above.
  5. (a) The playing of dominoes or cribbage in a place to which the public has access, and in respect of which a justices’ on licence is in force, is exempt from the prohibition on gaming in a public place by virtue of s.6 Gaming Act 1968. (b) Reference is made to the Permit granted under s.6(3) Gaming Act 1968 on 4th June 1970, authorising the playing of other games, namely nap, fat and solo whist.
  6. No additional licence is required for the provision in the premises of public entertainment by the reproduction of wireless (including television) broadcasts or of programmes included in any programme service (within the meaning of the Broadcasting Act 1990) other than a sound or television broadcasting service, or of public entertainment by way of music or singing only which is provided solely by the reproduction of recorded sound.   7. Floodlights in the car parking area will be maintained and illuminated in the absence of adequate daylight at all times when members of the public are present. Public Safety
  8. All parts of the premises used for means of escape in case of fire shall be kept entirely free from obstruction, whether permanent or temporary, so as to not impede safe evacuation of the premises.
  9. All parts of the premises and its external escape routes to which the public have access shall be suitably illuminated in the absence of adequate daylight at all times when members of the public are present.
  10. Fire fighting appliances indicated on the drawing submitted with the application shall be maintained and immediately available for use.
  11. No vehicle shall be parked in such a way as to restrict the means of escape provided from the premises, or prevent the safe access and egress of the emergency services. Prevention of Public Nuisance
  12. The volume of the amplification system for any description of musical entertainment shall be strictly controlled so that noise levels are non-intrusive at the boundaries of nearby residential properties.
  13. A responsible person shall monitor the music levels outside the building, and implement any changes to reduce the noise levels in accordance with any request by an authorised office of the Council immediately and ensure that volume is maintained at the reduced level.
  14. The permitted entertainment outdoors shall only be allowed on 30 nights in one calendar year and all such outdoor entertainment shall finish no later than 23:00hrs. Protection of Children from Harm
  15. Both the DPS and the Premises Licence holder will be aware of the legal requirements in relation to children, and their safety, on the licensed premises.
