Licence conditions (36)
  1. Staff will undertake training in their responsibilities regarding the sale of alcohol, with regards to Drunkenness. Records will be kept of training and refresher training.
  2. Digital CCTV and appropriate recording equipment to be installed in accordance with Home Office Guidelines relating to Police requirements for Digital CCTV System operated and maintained throughout the premises internally and externally to cover all public areas, including the entrance to the Premises.
  3. The CCTV Cameras and recording equipment will be of sufficient quality to work in normal lighting levels inside the premises at all times. .
  4. CCTV footage will be stored for a minimum of 28 days and the management will give full and immediate co-operation and technical assistance to the Police in the event that CCTV footage is required for the prevention and detection of suspected or alleged crime. Subject to the Data Protection Guidance and Legislation
  5. The CCTV images will record and display dates and times and these times will be checked regularly to ensure their accuracy.
  6. The management of the Premises will ensure staff are fully trained in the operation of the CCTV and will be able to download selected footage onto a disc for the Police without difficulty and delay and without charge to the Police.
  7. Any breakdown or system failure will be notified to the Police immediately and remedied as soon as practicable.
  8. A logbook or recording system shall be kept upon the Premises to record Inspections required by statute and information compiled to comply with any Public Safety condition on the Premises Licence that requires recording of such information.
  9. All parts of the Premises and all fittings and apparatus therein will be maintained at all times in good order and safe condition.
  10. Prominent clear and legible notices will be displayed at all exits requesting the public respect the needs of nearby residents and to leave the premises and area quietly.
  11. The Licensee will ensure that staff who arrive early morning or depart late at night when the business has ceased trading avoid causing disturbance to nearby residents.
  12. Customers will be asked not to stand around talking in the street outside the premises and will be asked to leave the vicinity quickly and quietly.
  13. A specific taxi operator has been nominated for staff and customers use. The company's telephone number will be made available to customers.
  14. The taxi operator and all drivers will be made aware that they should arrive and depart as quietly as possible, and not sound vehicle horns as a signal of their arrival or leave their engines running.
  15. Bright lights on or outside the Premises will be positioned and screened in such a way that nearby residents are not disturbed by the lighting.
  16. Adequate waste receptacles for use by customers will be provided in the local vicinity
  17. The movement of bins and rubbish outside the Premises will be kept to a minimum after 2300 to reduce levels of noise emanating from the Premises.
  18. The premises will operate a Challenge 25 policy whereby any person attempting to buy alcohol who appears to be under 25 will be asked for photographic ID to prove their age
  19. The only forms of ID that will be accepted are passports, driving licences with a photo, or proof of age cards bearing the PASS mark hologram. The list of approved forms of ID may be amended or revised with the agreement of the Police and Licensing Authority.
  20. Suitable and sufficient signage advertising Challenge 25 is operating in the premises and its policy will be displayed in prominent parts of the premises.
  21. All staff members engaged or to be engaged in the selling or delivery of alcohol on or from the premises will receive the following training in age -restricted sales.
  22. Induction training which must be completed and fully documented prior to the staff member being able to make sales of alcohol, refresher training will take place at intervals of no less than 8 weeks.
  23. All age restricted sales training undertaken by staff members will be fully documented and recorded. These records will be made available to Police, Trading Standards and Licensing Authority officers upon request.
  24. The Premises shall at all times operate and maintain a refusals recording system (Either book or electronic format) this will be reviewed by the Designated Premises Supervisor at intervals not to exceed 4 weeks and feedback given to staff as relevant. The refusals recording system shall be available on request to Police, Trading Standards and the Licensing Authority.
  25. Home Delivery
  26. At the time of ordering for home delivery, the following details shall be recorded and made available for inspection by a responsible authority under the Licensing Act 2003 (a) the full name of the purchaser, (b) the address of the purchaser, (c) the telephone number and email address for the purchaser, (e) the method of payment and details of alcohol supplied, (f) confirmation the customer is over 18 years of age.
  27. Alcohol shall not be delivered other than to residential and business addresses with a postcode.
  28. If the delivery driver is not able to deliver the alcohol it shall be returned by the delivery company to the premises licence holder
  29. Alcohol shall not be delivered other than by adult delivery drivers. The delivery company/business owner shall record the name of the delivery driver who makes each delivery of alcohol.
  30. Alcohol shall only be delivered after full payment has first been received on-line, in person, or over the telephone. Delivery drivers shall only deliver the actual alcohol that has already been paid for in full on-line, in person, or over the telephone.
  31. Customers shall be advised that delivery drivers reserve the right to refuse delivery as follows: a. No adult is present, or the person accepting the delivery cannot produce ID on a 'Challenge 21/25' basis if requested. b. The person in receipt of the delivery appears to be intoxicated through alcohol/drugs. c. in the opinion of the delivery driver, the customer is exhibiting abusive behaviour.
  32. No alcohol shall be delivered other than by a delivery company/business owner staff that abides by these conditions.
  33. The driver shall only complete the delivery of alcohol to adults on a 'Challenge 21/25' basis and valid photo ID (Driving Licence /Passport/Pass Card)shall be required to be shown if the recipient appears to be less than 21/25 years of age.
  34. Customers at the time of ordering are to be reminded that it is a criminal offence for a person under 18 years to purchase or attempt to purchase alcohol for themselves or on behalf of a person under the age of 18 years.
  35. At the time of ordering, if the purchaser is purchasing alcohol as a gift for a third party (the recipient) the following details shall be recorded and made available for inspection by a responsible authority under the Licensing Act 2003 (a) the full name of the recipient, (b) the address of the recipient, (c) the method of payment and details of alcohol supplied, (f) confirmation that the recipient is over 18 years of age.
  36. All terms and conditions on the licence must be displayed on any promotional website.
