Licence conditions (40)

PPN4 All external doors and windows shall be kept closed when regulated entertainment is being provided except in the event of an emergency. PPN6 The licence holder or his representative shall conduct regular assessments of the noise coming from the premises on every occasion the premises are used for regulated entertainment and shall take steps to reduce the level of noise where it is likely to cause a disturbance to local residents. A written record shall be made of those assessments in a log book kept for that purpose and shall include the time and date of the checks, the person making them and the results including any remedial action. PPN10 No explosive, firework or pyrotechnic shall be discharged in or from the premises which may cause a disturbance to the local area. Notice of a proposed event shall be served on the Council, the Chief Fire Officer, the Environmental Health Officer and the Chief Police Officer, not less than 28 days before the proposed date of any such event. Any such event shall be conducted in accordance with conditions or restrictions required by the Chief Fire Officer, the Environmental Health Officer and the Chief Police Officer. PPN14 The placing of bottles into receptacles outside the premises is not permitted to take place after/between the hours of 2000 and 0800 to minimise disturbance to nearby properties.
PS1 - Gas Testing Any gas boiler, calorifier or other gas appliances will be tested at least every 12 months by CORGI authorised workmen and subsequent satisfactory and valid inspection report to be available on site for inspection by an authorised officer of the authority. PS2 - Electrical Installation Testing The electrical installation shall be inspected and tested at intervals specified by a competent person. A satisfactory and valid inspection report shall be available on site for inspection by an officer of the authority. PS4 - RCD Each socket outlet circuit or individual socket outlets used for public entertainment shall be protected by an integral residual current device (RCD) having a rated residual operating current not exceeding 30mA (0.03 amps). Every such circuit and residual current device shall be inspected and tested at intervals specified by a competent person. A satisfactory and valid inspection report shall be available on site for inspection by an authorised officer of the authority. PS5 - Licensee Safety Inspection Before the premises are opened for the purposes authorised by the licence an inspection shall be carried out by the licence holder to ensure that the premises are safe for use. PS6 - First Aid There shall be maintained on the premises at all times an adequate and appropriate supply of first aid equipment and materials for the use of customers.
The licence holder, representative shall conduct regular assessments (hourly) of the noise coming from the site and shall take steps to reduce the level of noise where it is likely to cause a disturbance to local residents. A written record shall be made of those assessments in a log book kept for that purpose and shall include the time and date of the checks, the person making them and the results including any remedial action.
The use of noise limiters are advised for the stages as this sets a maximum volume for the music. It is also important to set maximum levels for the low frequency levels (bass) as these cause the most disturbance to local residents. This noise limit must be set by Environmental Health prior to events. It is the responsibility of the applicant to contact them to make an appointment.
One of the most frequently encountered problems is that an unnecessarily large amount of sound equipment is provided, which makes effective control very difficult. The output of the sound system(s) should be suitable for the size of the event, and as a general rule it should be calculated on the basis of 1KW per 100 people in the audience expected.
The noise levels emanating from the site for all live amplified music/entertainment when measured at the monitoring locations (as specified in condition 1) shall not exceed an equivalent continuous sound pressure level (LAeq) of 60 dBA. In particular, this will apply to the 63Hz and 125Hz octave frequency bands.
Over the duration of the event the equivalent continuous sound pressure level (Event Leq) in any part of the audience area should not exceed 107dB(A).
The peak sound pressure level in the public area shall not exceed 120dB and shall normally be below 100dB for the duration of the event.
The audience should not be allowed within 3m of any loud speaker. Where this is not practical and suitable evidence of justification is provided, the overall music sound levels can be modified so that people closer than 3m to the loud speakers are not exposed to an Event Leq of more than 107dB(A) or peak sound pressure levels of 120dB. Under no circumstances should the audience and loudspeaker separation distance be less than 1m.
A Noise Management Plan must be submitted to the Environmental Health at least two months prior to the first day of each event. This must cover all aspects of the day and in particular, steps to be taken to manage noise pollution, number of stages, location, orientation and operational times of each stage. This must be received and agreed by the department before the event commences. It should also include details of the sound system being used, noise predictions to assess noise levels at noise sensitive properties surrounding the event site and details of sound control and monitoring scheme that will be put into place to minimise noise levels to achieve compliance with the conditions of this licence.
A contact name and number should be provided to the Environmental Health Department prior to each event and it is recommended that there is a letter drop at the nearest noise sensitive properties before the event providing a contact name and number for complaints. These complaints should be logged and the Duty Manager will investigate the noise and take appropriate action to locate and reduce the source and will then continue to monitor the situation and provide a report to both complainant and the Environmental Health Department.
The music noise levels during each Event shall be measured using a calibrated integrating averaging sound level meter complying with Type 2 or better of BS6698. A weighted F (fast response) shall be used.
If an officer of Environmental Health believes that the levels audible outside the premises are unacceptable then, at the request of the Officer, the noise control consultant shall adjust the volume of sound accordingly to the requirements of the Officer.
A letter shall be circulated to local residents of Station Road and Meadow Close prior to each event detailing the start and finish times of the Event and times of sound checks and a dedicated phone number for complaints.
The licensee shall provide names and contact numbers to Environmental Health for various individuals who will ensure compliance with the conditions.
If any lighting were required on site then light from or on the premises and any other light under the control of the premises shall not cause nuisance to any nearby premises.
No regulated entertainment external to the premises beyond 11pm.
PPN14 - Bottle disposal The placing of bottles into receptacles outside the premises is not permitted to take place after/between the hours of 8pm and 8am to minimise disturbance to nearby properties on any day except Sunday when no such disposal shall take place before 10am.
PPN3a - Control of PA system Where regulated entertainment is provided by way of an in house PA system, management shall control such equipment to ensure nuisance is not caused.
PPN4 - External doors and windows All external doors and windows shall be kept closed when regulated entertainment is being provided except in the event of an emergency (if internal).
PPN12 - Lobby entrance All entrances and exits have a lobby entrance with at least one set of doors closed at all times to minimise the breakout of noise.
The Directors and Committee have been made aware of the 4 licensing objectives and will maintain them at all times with regard to the sale of alcohol and live entertainment.
The Committee have agreed to display Crime Prevention and Disorder notices in the premises to prevent opportunist theft and Door Supervisors to prevent disorder.
The Committee have produced a Risk Assessment document to ensure Public Safety at all times.
Members of the Committee will ensure that properly trained Door Supervisors will be engaged at live entertainment to prevent public nuisance when clients are leaving the premises without causing further disorder.
The Club has a Welfare Officer with regard to activities for children. No children under 16 will be allowed into premises for live entertainment. On other occasions they will not be allowed without the supervision of their parents. CONDITION AMENDED BY VARIATION ON 24 JULY 2012
i The Club has a Child Welfare Officer which regard to activities of children. During functions where it is deemed necessary to employ door staff, a strict over 18s only admittance policy to be in place, and a “Challenge 25” Policy to be operated. ii Persons under 16 to be admitted to the premises during bar opening hours only for sports of recreation related purpose. If so admitted, they must be under general supervision of a responsible adult over the age of 25. iii Under 16s to be admitted as guests at family orientated events under the same supervision criteria as above.
When planning an event we will notify the Licensing Authority and Responsible Authority well in advance of the event taking place with details of the type of event, site plan and proposed capacity. No tickets will go on general sale for any event until at least 14 days after the notifications have been sent out. We are happy to agree to a Notice Period for events.
For all major events we will be using SIA Registered Security and will be also working closely with the Police for traffic management and public safety.
The site will be thoroughly checked prior to any event and a Risk Assessment will be available for inspection by the Responsible Authorities.
When we are using a marquee and for certain events the site will have temporary security fencing.
We will liaise with Allerdale Borough Council and Environmental Health and the Police when planning events.
The Club has a Child Protection Policy and Child Welfare Officer, and all qualified coaches are checked as part of the Licence Application with the RFL.
We will have a Lost Children collection point clearly marked for events where children are to be permitted.
Conditions of the premises licence are regularly discussed by the General Committee of the Club and deviations identified as a matter of urgency as are premises related concerns brought to the Committee’s attention by members of the public.
For functions whose target market is mainly young people aged between 18 and 21, the club booking conditions explicitly state that SIA Registered Door Staff must be employed. The relevant Door Supervisor will take responsibility at these functions to ensure that no nuisance is caused to neighbouring properties. At such events a “Challenge 25” Policy will be applied. All alcohol served at these events will be in plastic containers.
The Club has a rigorous testing regime for gas and electrical installations. A comprehensive risk assessment is undertaken annually and evacuation plan updated.
The Club is fully aware of its proximity to neighbouring properties and acts immediately on any feedback received from residents. In particular, the club understands the impact of noise that emanates from the premises and takes all reasonable steps to reduce this to a level that does not result in adverse impact on neighbours.

The Club has a clear admission policy for young people under the age of 18.
